Be it remembered that heretofore to wit on the 15th day of May? in the year one thousand eight hundred and eighty three Mary Sabin the widow named in the last will and testament of Charles Sabin late of the town of Fort Covington County of Franklin and State of New York deceased appeared in open court before the Surrogate of the County of Franklin and made application to have the said last will and testament which relates to both real and personal estate proved and on such application the Surrogate did ascertain by satisfactory evidence who were the widow and heirs at law and next of kin of the said testator and their respective residences and the said Surrogate did thereupon issue a citation in due form of law directed to the said widow, heirs and next of kin by their respective names stating their respective place of residence requiring them to appear before said Surrogate at his office in Malone Village on the 28th day of May 1883 to attend the probate of the said will and afterwards to wit on the said 28 day of May satisfactory evidence by affadavit was produced and presented to said Surrogate of the service of the said citation in the mode prescribed by law and on that day the petitioner appeared by her attorney and the said matter was adjourned to the 14th day of February and on that day it appearing that one of the witnesses to the said will not being present the matter was further adjourned to the 25 day of April 1884 in order that the attendance of said witness can be procured. And on that day no one appearing to oppose the probate of such will such proceedings were thereupon had. Afterwards that the surrogate took the proof of the said will hereinafter set forth upon this 25th day of April in the year one thousand eight hundred and eighty four and he adjudged the said will to be a valid will of real and personal estate and the proof thereof to be sufficient which said last will and testament and proof are as follows that is to say: WILL I, Charles Sabin of Fort Covington, NY, being of sound mind and memory do make, ordain, publish and declare this to be my last will and testament that is to say: FIRST After all my lawful debts are paid and discharged I give devise and bequeath to my wife Mary Sabin the use of all my property both real and personal during her natural life. SECOND I give to Charles Wilson, my sister's son five hundred dollars to be received by him within one year after the death of my said wife Mary. All the rest and residue of my property of every nature or kind whatsoever is to be equally divided between my daughters [sic] Sarah Ann Sabins and Westley Fuller within one year after the death of my said wife Mary. Likewise I make, constitute and appoint Walter H. Manchester of Fort Covington NY to be executor of this my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto subscribed my name and affixed my seal the 21st day of November in the year of our Lord one thousand eight hundred and eighty one. We at the time of making and subscribing acknowledged that he made the same and declared the said instrument so subscribed my him to be his last will and testament whereupon we then and there at his request and in his presence and presence of each other subscribed our names as witnesses thereto. Allen residing at Fort Covington, NY William Gillis residing at Fort Covington, NY Surrogates Court County of Franklin New York In the matter of the last Will and Testament of Charles Sabin deceased. Examination of witnesses produced, sworn and examined in the above entitled matter County of Franklin ss Henry W.P. Allen being duly sworn and examined before Horace A. Taylor Surrogate of the County of Franklin on behalf of the applicant to prove said will does depose and say as follows: I was well acquainted with Charles Sabin deceased. The subscription of the name of said decendent to the instrument now shown to me and offered for probate as his last will and testament and bearing the date the 21st day of November in the year of our Lord one thousand eight hundred and eighty one was made by the decedent at the residence of decedent in Fort Covington in the presence of deposed and William Gillis and each of us subscribing witnesses to said instrument. At the time of his making such subscription the said decedent declared the said instrument so subscribed by him to be his last will and testament and we the undersigned and the said William Gillis therefore subscribed our names as witnesses at the end of said instrument at the request of said decedent and in his presence and in the presence of each other. The said decedent at the time of so executing said instrument was upward of the age of twenty one years and a citizen of the United States and of sound mind memory and understanding and not under restraint or in any way incompetent to devise real estate. Taylor Surrogate Surrogates Court County of Franklin, New York In the matter of the last Will and Testament of Charles Sabin Deceased Examination of witnesses produced sworn and examined in the above entitled matter County of Franklin ss William Gillis being duly sworn and examined before Horace A. Taylor Surrogate of the County of Franklin in behalf of the applicant to prove said will deposes and says as follows: I was well acquainted with Charles Sabin deceased. Allen therefore subscribed our names as witnesses at the end of said instrument each at the request of said decedent and in his presence and in the presence of each other. Taylor, Surrogate Additional Comments: Transcriber's Note: Charles Sabin (Jr.) was born about 1825 in Fort Covington, Franklin County, NY. He was the son of Charles and Esther Sabin. He died about 1882. He was married to Mary Sutton, born about 1819 in Massena, St. Lawrence County. Mary Sabin died in Malone and was buried in Westville, Franklin County.
