State of New York County of Fulton On this twenty fifth day of October 1849 ---- ---- appeared in ---- ---- county Court of Fulton County sitting Josiah Benjamin a resident of the Town of Johnstown(?) In the County and State of New York aged eighty eight (88) years. Who being first duly sworn according to law doth on his oath make the following declaration in order to obtain the benefits of the act of Congress passed June first 1832. That he entered the service of the United ----------. ----- ------ made differs and ------- as ----- after. Noted that he was born in Duchess County of the State in the month of September in the year one thousand and seventeen hundred and sixty one (1761) That he has in his possession a family Bible containing a record of his age. That when the revolutionary war commenced he was residing with his father whose surname he bears, in the town of Stillwater. Then ----- --, now Saratoga County. That he resided in the last winter a town during the war and for several years after war and then went over to Salisbury Herkimer County, and then took up his residence in Fulton County where he now resides Affiant ------- and declares that from the length of time since the services were tendered and on account of extreme old age that it is not --------- --------- to give the dates and ---- length of time he served under the ------ --- ---- ------- ------ ----- that first served he entered was as teamster under a Captain Case(?) Who had charge of nine (9) or ten (10) teams and that he served in that capacity for nine (9) months and believes it to have been in the year one thousand seven hundred seventy seven (1777) . That he commenced his services as aforesaid in the early part of spring of the last mentioned year. That often having rendered services as aforesaid he served as a private and done duty as such in Captain ----- Thompson's company of --------- --------- --- -------- regiment of militia. That his father Josiah Benjamin was Lieutenant in said company and Isaac Fonda was Ensign. That he also served in Captain Ephraim(?) Woodworth(?) Company and Captain ------- ------- Company, both of the regiment aforesaid. That he knows and recollects of having done duty under different officers above named. That from the summer of one thousand seven hundred and seventy nine (1779) he was engaged in no other business or employment than the service of his country and that said services were continued until the fall of the year one thousand seven hundred and eighty one (1781). That he done much duty as private in scouting parties under different officers above mentioned in going to and fro through from Stillwater to Fort Edward to Fort George to Lake George, Sandy Hill, Ticonderoga, Crown Point to Tansanack(?) Island, to Schnectadi to Johnstown and the he was while at Stillwater on duty detailed among others under Sergeant Gage --------- and take to Albany six (6) prisoners, does not now recollect the names of any of said ----- Affiant further saith that his father drew all his pay as teamster and drew most of his pay for services rendered as soldier. That the different officers under whom he served done much duty separate and apart from the immediate Company(?). --- Col. Van ------(?) To whose Regiment they belonged that he believes General Gates was in command at Ft Edwards. The first time he arrived there under Captain Woodworth(?) From Stillwater. That ----- ----- many troops were at said Fort ----- ----- -----. Affiant further saith that during ----- he never was in any engagement in Stillwater ------ -----, but that he served in Ticondaroga ------- with a willing hand, and gives as a reason for not making application for a pension sooner that he did not want it although after ----- to make application, until now his present circumstances require sais affiant further saith that his discharge if ever he had one in form(?), and papers connected with his services as teamster have -- -- since been lost, That he knows of but one person surviving, who knows of his having rendered services in the Revolutionary War as herein stated that the person referred to is Elej(?) Baker(?) Residing in the town of Malta in the County of Saratoga. That affiant and said Baker resided in the town of Stillwater, occupying the same house for a year previous to the Revolutionary War. That they served during the War in the same Company under same officers. That we believe him to be eighty eight (88) years of age. That he is reputed and believed in the neighborhood where he resides to have been a soldier of the Revolution and that we concur in that opinion. D., eighteen hundred and fifty two, before the undersigned, a Justice of the Peace in and for the County and State aforesaid, personally appeared Matilda Case, a resident of Ephratah in said County and made oath according to law that she is the identical person who is a daughter of Josiah Benjamin deceased(?) And, who executed the foregoing power of attorney, and that she is directly interested in said claim, and makes this affidavit to be filed with such additional evidence or arguments as said Agent may use in prosecuting said claim. Sworn and subscribed, the day and year aforesaid, before Wm. Spencer (signed) J. Peace Matilda Case (signed) I, Wm Spencer (signed) Justice of the peace, in and for said County do hereby certify that Matilda Case who executed the foregoing papers is a respectable resident of this County, and is, I believe, directly interested in said claim as therein set forth. Wm Spencer J. Peace (signed) I, Peter W. Plantz(?) (Signed), Clerk of the County Court in the County and State aforesaid, do hereby certify that Wm Spencer before whom the foregoing papers were executed, was, at the date of the same, a Justice of the Peace in and for said County, duly authorized by law to administer oaths; and the same thereunto subscriber is (I verify believe) his signature. In Testimony Whereof, I have hereunto subscribed my hand and affixed my official Seal this eighteenth day of December A. D. 1852. (Signed) Peter W. Plantz(?) Clerk Whereas, I Eliakim(?) Benjamin of the town of Salisbury in the County of Herkimer N.Y. Am a son of Josiah Benjamin late of the County of Fulton, deceased, who was a soldier in the war of the Revolution and who made application for a pension under the act of Congress passed June 7thA.D. 1832 for his services in said War, which said application was rejected, and whereas I am advised that a pension should have been allowed him, and that his children are entitled to any pension, or arrears of pension that may be due(?) Him and withdrawn at mention of his death. Now therefore I do duly constitute and appoint Sam H Wells(?) Of the city of Albany and ------- - ------- Esquire of the City of Washington D.C. my true and lawful agents and attorneys for me and in my name and on account of the children of said Josiah Benjamin, to examine into any prosecute on claim to such amount of pension, or arrears of pension as we may be by law entitled to. And I do duly make this power of attorney irrevocable during one year from this date. Witness my hand and seal at Salisbury this 30th day of September A. D. 1852.
