To all to whom these presents shall come or may concern send greeting Know ye that at Johnstown in the County of Montgomery before James Lansing Esquire surrogate of our said county the last will & testament of Conradt Hart deceased [a copy whereof is hereunto annexed(?)] was proved & is now approved & allowed by us & the said deceased having whilst he lived & at the time of his death goods chattels or credits within this estate by means where of the proving & registering the said will & the granting administration of all & singular the said goods chattels & credits & also the auditing allowing & final discharging the account thereof states(?) belong unto us the administration of all & singular the goods, chattels & credits of the said deceased & my way concerning his will is granted unto Henry C Hart one of the executors in the said will named he being first duly sworn will & fruitfully to administer the same & to make & exhibit a true and perfect inventory of all & singular the said goods & chattels & credits & also to render a just and true account thereof when there unto required. In testimony whereof we have caused the seal of office of our said surrogate to be hereunto affixed Witness James Lansing Esquire Surrogate of said county at Johnstown the twenty eight day of January in the year of our Lord one thousand eight hundred & fifteen & of our Independence the thirty ninth James Lansing In the name of God amen I Conradt Hart of the town of Palatine in the county of Montgomery & State of New York being sick & weak in body but of a sound perfect & disposing mind & memory blessed be God for it and considering the mortality of my body and the uncertainty of the hour of Death do this fourth day of March in the year of our Lord one thousand eight-hundred & thirteen make & publish the my last will & testament in the following manner & form (that is to say) principally & first of all I give & recommend my soul into the hands of Almighty God who gave it and my body to the earth whence it came to be buried at the discretion of the my executors herein after named & appointed touching & conceiving such of my worldly estate where with it hath pleased the Almighty to help me in this life. I give, devise & dispose the same as follows Imprimus I will that all my just debts which I owe & my funeral charges shall be honestly paid by my executors out of my estate & all my outstanding debts justly due to me shall be by them allocated & applied to the use of my estate & for the payment of the aforesaid debts which I owe. Item. I give, devise & dispose to my beloved wife Abbolana for & during her widowhood of me & no longer a competent decent & comfortable maintainance on my said estate such as she us'd to have in my lifetime with the same mastership(?) & commands on my said estate as she had in my lifetime. I further give & bequeath unto her for her own use & disposal my bed at present occupied by me with the furniture thereunto belonging & also her wearing apparel. Item. I give desire & dispose to my brother Brother Wilhelmus for his faithfull services rendered by him to me a maintainance during his lifetime on my said estate similar to that of my said wife as well in sickness and as in health together with decent & warm clothing for every day & holy day. Item. I give desire & bequeath unto my sons Henry, Adam, & Fredric my farm where I now live known to be a part of lot No five hundred & seventy in the western allotment of Kingsborough in the town aforesaid also fifty acres of land which I purchased from Adam J. Steele(?) known to be South West part of Lot No five hundred & sixty nine in the aforesaid allotment to be equally & equitably divided between them share & share alike, together with all & singular the tenement & buildings thereon Also all the deeds evidences & writings touching & concerning the said premises to have & to hold the said premises appurtenances unto the use of my said sons Henry, Adam, & Fredrick their heirs & assigns for use (under the premise(?) that the desire to my said wife Abbalina & my brother Wilhelmus herein charged upon my said sons Henry Adam & Fredrick for the maintainance of my said wife & Brother be exactly & strictly performed & discharged) I further give & bequeath to sons aforesaid all & singular my stock of Horses & mares & my stocks of meat cattle sheep & swine also my waggons sleighs ploughs harrows & all & singular my farming utensils & household furniture of what kind & nature forever. Should it however please the Almighty to call either of my said sons home without lawful heirs? I then will & dispose that the ?? of the deceased shall dissolve on the survivor or survivors of them their heirs & assigns for ever. Item. I give and dispose to my daughter Maria in addition to what she has already secured the sum of fifty dollars lawfull money of the United States in two annual payments of twenty five dollars per annum to commence to years after my decease & to be raised & levied out of my said estate. Item. I give and bequeath unto my Daughter Margrat (?) the sum of seventy Dollars of like lawfull money as aforesaid to be raised & levied out of my said estate in two annual payments of thirty five Dollars per annum to commence four years after my decease. And lastly I do make constitute and appoint my said son Henry, John Spanknelle Junr Hamilton McCollister of said town my trusty friends for executors of this my last will & testament & I do hereby utterly disallow disannull and revoke all & every other former testaments wills Legacies bequests & Executors by me in any will before procured(?) willed & bequeathed verifying(?) & confirming this and no other to be my last will & testament. In testimony wherof I the said Conradt Hart have hereunto set my hand & seal the hourth Day of March Anas Dormini 1813 Conradt his X mark Hart LS Signed sealed published & declared by the above named Conradt Hart to be his last will & testament in the presence of us who in his presence & in the presence of each other have hereunto published our names. Note the words the and day in the 16th & 27th lines of first page & of said town in the 25th line of 2nd page were duly interlined(?) before execution thereof. Richard Young Be it remembered that on the twenty eight Day of January in the year of our Lord one thousand and Eight-hundred & fifteen personally appear before me James Lansing surrogate of the county of Montgomery Henry Hart & Richard Young who being duly sworn personally depose & say that they saw Conradt Hart sign & seal & heard him publish & declare the foregoing instrument as & for his last will & testament That the said Conradt Hart was at the time thereof (according to the best of the judgement & belief of these deposements of sound & disposing mind memory & understand that these deposements respectfully subscribed their names thereunto as witnesses to the ?? thereof in the presence of the said Conradt Hart the testator & that they at the same time saw John Spankville Junr subscribe his name thereto as a witness to the execution thereof also in the presence of said testator.
