First I give and devise unto my grand-son, Ansel D Joslin, one fifth part of my real & personal property to be paid him by my executors when he arrives to the age of twenty one years. Secondly, I give & devise unto my grand-daughter, Mary Joslin on fifth part of my real & personal property to be paid her when she arrives to the age of eighteen years. Thirdly, I give and devise unto my grand- son Thomas H Joslin, one fifth part of my real & personal property to be paid him when he arrives to the age of twenty one years. Fourthly, I give and devise unto my grand-daughter, Martha Joslin, one fifth part of my real & personal property to be paid her when she arrives to the age of eighteen years. Lastly, I give and devise unto my grand-daughter Elisabeth Joslin one fifth part of my real & personal property when she arrives to the age of eighteen years and I will that my executors convert any real estate into money and put that out on instruct to be paid by them to the above heirs as above written and should any of the above heirs depart their life before they become of age, I will that my executors divide their share equally between them that survive the others. The above divisions to made after my executors pay all my just debts & funeral charges and I do appoint Arthur Smith and James T Joslin executors of my last will and testament. In writing whereof I have herewith set my hand and seal this 26th of May 1843. Thomas Hopkins Signed, sealed and published as the last will & testament of Thomas Hopkins in the presence of us, who have at the request of the testator & in his presence & in the presence of each other hereunto affixed our names as witness. Solomon S Jeffers, Resident of Amsterdam John Martindale, Resident of Amsterdam Thomas Allen, Resident of Amsterdam Depositions: County of Fulton, Surrogate Court, In the matter of proving the last will and testament of Thomas Hopkins, deceased, Fulton County. Solomon Jeffers of Amsterdam in the County of Montgomery being sworn & examined before John Wells, County Judge says that he was well acquainted with Thomas Hopkins, deceased that he was present and also John Martindale was present as witness and this deponent saw the said Thomas Hopkins subscribe his name at the end of the instrument in writing now produced & shown to the deponent, bearing date the 26th day of May 1843 purporting to be the last will and testament of the said Thomas Hopkins, deceased. That the said Thomas Hopkins at the time of making the said subscription declared the said instrument to be his last will & testament and requested this deponent said John Martindale to sign their names as witness thereto whereupon this deponent and the said John Martindale accordingly each signed his name as a witness at the end of the said instrument. This deponent says that the said Thomas Hopkins at the time he so executed the said instrument was a citizen of the United States of full age of sound mind & memory in all respects competent to devise real estate and not under restraint and that the said John Martindale has removed of this state and resides in Canada. John Wells, County Judge In the matter of proving the last will & testament of Thomas Hopkins, deceased, Fulton County, Thomas Allen of Amsterdam, Montgomery County being sworn & examined before John Wells, County Judge says that he was well acquainted with Thomas Hopkins, deceased that in the year of 1843 he was present with the said Thomas Hopkins. That the said Thomas there produced & showed to this deponent, bearing date the 26th day of May 1843 & purporting to be the last will & testament of the said Thomas Hopkins. The said Thomas then declared that the said instrument was his will and acknowledged & said to this deponent that he had signed and executed the said instrument for the purpose therein mentioned. The signature of the name of the said Thomas at the end of the said instrument was then on the said will and he said it was his writing. The said Thomas Hopkins thereupon requested the deponent to sign his name to the said instrument as a witness thereof. Whereupon this deponent accordingly signed his name as a witness at the end of the said instrument. This deponent further says that said Thomas at the time he made such acknowledgement was a citizen of the United States of full age of sound mind & memory & not under restraint.
