Probate Records (fhl 513999) Written: May 19 1858 Recorded: November 28 1859 Vol 5 pg 204-205 Baltus Hollenbeck Will (19 May 1858) & Probate (Nov 28, 1859) (FHL 513999) Be it remembered that on this twenty eighth day of November in the year one thousand eight hundred & fifty nine Mary Hollenbeck, Philip Hollenbeck, John Hollenbeck, Jacob B. Hollenbeck, Michael B. Hollenbeck, Magdalen Van Nest [or Vest] Margaret Argotsinger, Magdalen Hollenbeck David Hollenbeck, Henry Hollenbeck & Baltus Hollenbeck, Jr. the widow, heirs & next of kin of Baltus Hollenbeck late of the town of Johnstown in the county of Fulton deceased appeared in the surrogates court of the said county & made application to have the last will & testament of the said Baltus Hollenbeck decd which relates to both real & personal estate proved immediately & admitted to probate without opening any citation on the said application and on such application the county Judge of said County of Fulton acting as surrogate did ascertain by satisfactory evidence that the said petitioners & applicants were the only widow & heirs at law & next of kin of the said Baltus Hollenbeck deceased, and afterward to wit on the same day such proceedings were thereupon that the county judge of the county of Fulton acting as surrogate took the proof of said will hereafter set forth upon this 28th day of November in the year 1859 and he adjudged the said will to be a valid will of real & personal estate and the proof, thereof to be sufficient which said last will & testament & proof are as follows that is to say Will I Baltus Hollenbeck of Johnstown in Fulton County do hereby make this my last will & testament this nineteenth day of May in the year 1858 in manner following [unknown word or initials:]: I give and devise my wood lot near John Peck & being part of lot No. 91 in Mayfield Patent consisting of one hundred & twenty five acres of land to my sons Philip & Michael in trust that they shall hold or sell the same for the benefit & support of my son John during his life, and after his death I give the same or the proceed thereof to my said sons Philip & Michael, and I do direct my said sons Philip & Michael to support my said son John and do make his support a charge upon the said land or the proceed thereof. And I do authorize them if in their discretion they deem it best to sell the said land and in such case I direct them to invest the proceeds thereof & apply the income & interest thereof to the support of my said son John. All the reset of my property both real & personal after the payment of my debts I give to my wife to be hers during her life and after her death I give the same to my son Michael. I direct my wife to give to each of my daughters Margaret and Magdalen a cow. The same to be delivered in a year from next fall? And in case my wife is not then living then I direct my son Michael to give the said cows to my said daughters. I hereby appoint my son Philip to be the executor of this my last will & testament In witness whereof I have hereunto set my hand this 18th day of May in the year 1858 Baltus Hollenbeck In presence of John Wells [or Welk] Johnstown Fulton County NY Michael Heagle The above instrument was this 19th day of May 1858 subscribed by the above named testator in our presence and he did then in our presence declare the same to be his last will & testament and he requested us to attest the same as attesting(?) witnesses & did thereupon in his presence & in the presence of each other sign the names as such witnesses. Surrogates Court County of Fulton In the matter of proving the last will & testament of Baltus Hollenbeck deceased County of Fulton Ls John Wells [or Welk] Michael Heagle of Johnstown in said county being severally and duly sworn and summoned before John Stewart(?) County Judge of the county of Fulton doth each for himself depose & say that he was well acquainted with Baltus Hollenbeck, deceased, that he was present as a witness and did see the said Baltus Hollenbeck subscribe his name at the end of the instrument in writing now produced & shown to deponent bearing date the 19th day of May one thousand eight hundred and fifty eight purporting to be the last will & testament of the said Baltus Hollenbeck deceased That the said Baltus Hollenbeck at the time of making the said subscription declared the said instrument to be his last will & testament and requested these deponents to sign their names as witnesses thereto. Whereupon these deponents accordingly signed their names as witnesses at the end of the said instrument. These deponents further say that the said Baltus Hollenbeck at the time he so generated(?) the said instrument was a citizen of the United States of full age of sound mind and memory in all respects competent to devise real estate and not under restraint and that there deponents saw each other sign the said instrument at the end(?) thereof as witnesses in the presence of the said Baltus Hollenbeck and at his request.
