All rights reserved. http://www.usgwarchives.org/copyright.htm http://www.usgwarchives.org/ny/nyfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Johnna St. Clair gjclair@optonline.net February 27, 2008, 6:46 pm Source: Copy Of Original Written: April 27, 1811 Recorded: February 12, 1812 Abraham Johnson, Last Will and Testament - Batavia, Genesee Co., NY April 1811 The People of the State of New York by the grace of God and independent; I, Dodrig Loomis friend of Abraham Johnson late of the town of Batavia deceased send Greetings: Whereas the said Abraham Johnson whilst living and of sound mind and memory, to wit, on the twenty seventh day of April now last past, did duly make his last will and testament, a copy whereof and of the probate thereon is hereunto annexed, but by the said will the said Abraham appointed no executor thereof, whereby it has become necessary to appoint an administrator “with the will annexed’ and we being desirous that the Goods, Chattels and Credits of the said deceased may be well and faithfully administered applied and disposed of, as by law to such administrator “with the will annexed” doth appertain, Do grant unto the said Dodrig Loomis full power by these presents, to administer and faithfully dispose of all and singular the said Goods, Chattels and Credits as the land in this case requires, to ask, demand recall and receive the debts, which unto the said deceased whilst living and at the time of his death did belong; and to pay the debts which the said deceased did owe, so far as such goods, Chattels and Credits will thereunto extend, and as the law requires; hereby requiring you to make or cause to be made a true and perfect inventory of all & singular the Goods, Chattels and Credits of the said deceased, which have or shall come to your hands, possession or knowledge and the same so made to exhibit, or cause to be exhibited, into the office of the Surrogate of the County of Genesee at or before the expiration of six calendar months from the date hereof, and also to render a just and true account of the administration when thereunto required. And we do by these presents depute and constitute you, the said Dodrig Loomis administrator as aforesaid of all and singular the goods, chattels and credits which were of the said Abraham Johnson deceased. In testimony whereof we have caused the seal of office of our said Surrogate to be hereunto affixed. Witness Richard Smith, Esquire, Surrogate of our said county, at Batavia the Twelfth day of February in the year of our Lord one thousand eight hundred and twelve and of our independence the thirty sixth year. In the name of God amin. (sic) I Abraham Johnson of the town of Batavia, county of Genesee and State of New York being very sick and weak body, but of perfect mind and memory, thanks be given unto God, calling unto mind the mortality of my body and knowing that it is appointed for all men once to die, do make and ordain this my last will and testament, that is to say, principally and first of all I give and recommend my soul into the hands of Almighty God that gave it, and my body I commend to the earth to be buried in a decent Christian burial at the discretion of my executors, nothing doubting, wake at the General Resurrection I shall receive the same again by the mighty power of God and as touching such worldly estate wherewith it has pleased God to bless me in this life, I give demise and dispose of the same in the following manner and form. First, - I give and bequeath to Mary my dearly and beloved wife, all my estate and property as long as she doth live, and at her decease to give two thirds unto John my son, and one Dollar unto Catherine my daughter, and one Dollar to Polly Hudson, and one Dollar to Anne my daughter, and one Dollar to Nelly my daughter, and one Dollar to Phebe my daughter, and one Dollar to Joseph my son, and one Dollar to Sally my daughter, and the remainder that (is) left of my property I give unto William and Lucy and Polly my son and daughters, an equal division and also and I do hereby utterly disallow, revoke and discin each and every other former testament, wills, legacies, bequests and execution by me in any wise before named and willed and bequeathed, ratifying and confirming this and no other to be my last will and testament. In witness whereof I have hereunto set my hand and seal this twenty seventh day of April, in the year of our Lord one thousand eight hundred and eleven. Abraham Johnson L.S. Signed, sealed, published, pronounced and declared by the said Abraham Johnson as his last will and testament in the presence of us, who in his presence, and in the presence of each other, have hereunto subscribed our names. Be it remembered that on the twelfth day of February, in the year of our Lord One thousand, eight hundred and twelve, personally appeared before us Richard Smith, Esquire, Surrogate of the county of Genesee Dodrig Loomis, who being duly sworn did depose and say that the deponent saw Abraham Johnson, late of the county of Genesee declare, sign and seal the written instrument then shown unto him, of which the aforegoing is a true copy, purporting to be the last will and testament of the said Abraham Johnson, deceased, bearing date the twenty seventh day of April in the year of our Lord one thousand, eight hundred and eleven, that at the time heard the said Abraham Johnson was of sound, disposing mind and memory to the best of the knowledge and belief of him this deponent, and that he the deponent and Almon Whiney subscribed their names as witnesses to the said will in the presence of each other and in the presence of the testator.
