To Harmon Whipple son of Samuel Whipple late of the town of Riga deceased ------------ whereas the said Samuel Whipple whilst living and of sound mind and memory to wit on the twenty third day of June in the year of our Lord one thousand eight hundred and nineteen did duly make his last will and testament a copy where of and of the probate therein is hereunto annexed and by the said will appointed Samuel Whipple Junior executor thereof but the said Samuel hath renounced his executorship and refused to take upon him the burden of the said will whereby it has become necessary to appoint an administrator with the will annexed and we being disivous tht the Goods chattel and credity of the said deceased may be will and faithfully administered applied and disposed of as by law so such administrator with the will annexed doth assertain do grant unto the said Harmon Whipple full power by that protenty to administer and faithfully dispose of all and singular the said goods chattels and credits as the law in this case requires, so ask demand recover and seize the debts which --------- said deceased whilst living and at the time of his death did belong and so pay the debt, which the said deceased did owe so far as such goods, chattels and credits while there unto extend and the law requires hereby requiring you to make or cause to be made a ------ and perfect inventory of all and singular the goods chattels and credits the said deceased which have and shall come to your hands possessions or knowledge and the same so made to whilist or casue to be whilst into the office of the surrogate of the county of Genesee as before the expiration of six calender months from the date hereof and also to ---- ----- ---- and how account of administration when ------ required and we do by these presently dispute and constitute you the said Harmon Whipple administrator as aforesaid of all and singular the goods chattels and credits which were of the said Samuel Whipple deceased In testimony whereof we have caused the said of office our said surrogate to be hereunto affixed Wilmil Richan Smith Esquire Surrogate of our said county at Batavia the twentyth day of February in the year of our Lord one thousand eight hundred and twenty one. Richard Smith 1/210 COPY In the name of our God amen I Samuel Whipple of Riga in the county of Genesee and State of New York considering the uncertainity of this mortal life and being of sound and perfect mind and memory Blessed be almighty god for the same do make and (unreadable) establish this my last will and testament in mannor following that is to say First I give and bequeath unto my beloved wife Ester Whipple a good and comfortable living from and out of my estate so long as she shall remain my widow and provided she marries then and in such case I give and bequeath unto her one good bed and bedding and fifty dollars worth of womens clothing. I do also give and devise to my eldest son Samuel Whipple Junior to my son Harmon Whipple to my son Milton Whipple and to my son Austin Whipple their heirs and assigns all that my missuage or tenement --------- lying and being in the said Town of Riga in the county of Genesee together with all my other household estate whatsoever to hold to them the said Samuel Whipple Jr., Harmon Whipple, Milton Whipple, and Austin Whipple their heirs and assigns forever equally to be divided among them. I also give and bequeath to my son Oliver Whipple three hundred dollars to be paid out of my estate. I also give and bequeath unto my youngest son Daniel Whipple one dollar. I also give and bequeath to my daughter Lucy Russell the wife of Lanson Russell one dollar. I also give and bequeath unto my daughter Mary Whipple one cow and fifty dollars worth of household furniture. I also give and bequeath unto my daughter Jerusha Whipple one cow and one hundred and twenty five dollars in household furniture and neels cattle. I also give and bequeath unto my daughter Ester Whipple Jr. one cow and one hundred and twenty five dollars in household furniture. I also give and bequeath unto my daughter Ada Whipple one cow and five hundred dollars worth in household furniture. And lastly as to all the rest residue and remainder of my personal estate goods and chattels of what ------ and mature solven I give and bequeath the same to my sons Samuel Junior, Oliver, Harmon, Milton ,and Austin, to be equally divided among them the said Samuel Junior, Oliver, Harmon, Milton,and Austin, and I do hereby appoint my eldest son Samuel Junior sole executor of this my last will and testament hereby revoking all former will by me made. Signed sealed declared and published by the above named Samuel Whipple to be his last will and testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the testator James Lanson Shipman White Daniel Kelsey Genesee County fs Be it remembered that on the fifteenth day of February in the yaer of our Lord one thousand eight hundred and twenty one personally appeared before me Richard Smith Esquire surrogate of the said county, Daniel Kelsey who being duly sworn did dispose and say that he saw Samuel Whipple sign and seal the written instrument then shown unto him of which the foregoing is a true copy proposing to be the last will and testament of the said Samuel Whipple and bearing date the twenty third day of June in the year of our Lord one thousand eight hundred and nineteen that at the time thereof the said Samuel Whipple was of a sound disposing mind and memory to the best of the knowledge and belief of the said deponent and that he the said deponent and James Lanson and Shipman White signed their names as witnesses to the said insturment in the presence of each other and in the presence of the testator.
