I, Charles Aldrich of the town of Bethany, County of Genesee and Stat eof New York, considering the uncertainty of this mortal life and being weak in body but of sound and perfect mind and memory do make and publish this my last Will and testament in manner and form following (that is to say). First.- I do will order and direct that all my lawful debts be paid out of the first money which shall come in to the hands of my Executrix herein after named after my decesed. Second. I do give bequeath and devise to my beloved wife Elizabeth S. Aldrich the use occupation and control of one third part of all my freehold estate and of which I may die seized during her natural life and no longer. Third. I do give bequeath and devise to my sons Ransom E. Aldrich, Ezra M. Aldrich and Charles Aldrich Jur. and to my daughters Mary E. Aldrich and Charlotte Christina Aldrich all my estate both real and personal both in law and equity of which I may die seized to be equally divided amongst them to them and their heirs forever but it is my express will that neather of my said sons or daughters receive any portion of my said estate until they shall be respectively twenty one years of age except so much as shall be necessary for their support and education and I hereby will order and direct that my said wife Elizabeth S. Aldrich shall have the full use occupation and controll of all my estate but real and personal untill my said sons and daughters shall be respectively twenty one years of age provided however that if my said wife Elizabeth S. should marry before my sons and daughters or either of them shall be twenty one years of age in that case it is my will that proper persons be appointed Guardian or Guardians for such of my said sons and daughters or either of them as shall not at that time be twenty one years of age to take charge of the share or shares of such minor sons and daughters or either of them until they shall be of proper age to receive the same. But it is also my will that each of my said sons and daughters receive their full shares of my said estate as they shall respectively become twenty one years of age and that the shares of such only as are minors remain in the hands of my said wife or their guardians as the case may be. And as it may become necessary for the perfect settlement of all my estate and the payment of my debts or as it may hereafter be for the benefit of my heirs and legatees to sell some part or all of my freehold estate and as it is my whish that the same may be done if my said wife shall consider the same necessary and proper and for the benefit of my estate and my family. I do hereby authorise and impower my said wife Elizabeth S. Aldrich to sell convey and dispose of any part of my real estate or the whole of the same as she shall think necessary and proper for the payment of my debts or for the future benefit of my heirs and legatees and proper deeds according to the power in her vested by virtue of this will to make execute and delivers. I do hereby constitute and appoint my said wife Elizabeth S. Aldrich sole executrix of this my last will and testament hereby revoking all formers wills by me made.
