Genesee County Ss Josiah Pierson being duly sworn doth depose and say that he was acquainted with Benjamin Wright late of the town of Bergen, Genesee County, previous to his death that on or about the Seventeenth Day of December A. D. 1838 he saw the said Benjamin Wright sign and execute a certain instrument in writing purporting to be his last will and testament bearing date the said seventeenth day of December in the Year of our Lord one thousand eight hundred and thirty eight which is the same instrument now shewn unto him, that he heard the said Benjamin Wright declare the said to be his last will and testament at the time of the execution thereof and that at the time thereof the said Benjamin Wright was at his own dwelling house in Bergen aforesaid of sound mind and memory over the age of twenty-one years and under no manner of restraint according to the best judgment and belief of this deponent that this deponent signed the said will as a witness in the presence of the testator and at his request and that this deponent received the said will of the said testator and kept it in his possession until he delivered it to Jonathan Wright an executor therein named. Subscribed and Sworn to this Josiah Pierson 18th day of March A. D. 1839 before me Ebenezer Mix, Surrogate Genesee County Js George L. Goodenow being duly sworn doth depose and say that he was acquainted with Benjamin Wright late of the town of Bergen previous to his death that on or about the 17th day of December AD 1839 he saw the said Benjamin Wright sign and execute a certain instrument in writing purporting to be his last will and testament bearing the date the said seventeenth day of December in the year of our Lord one thousand eight hundred and thirty-eight which is the same instrument now shown unto him that he heard the said Benjamin Wright declare the said instrument to be his last will and testament at the time of the execution thereof that at the time thereof the said Benjamin Wright was at his own dwelling house in Bergen aforesaid of sound mind and memory over the age of twenty-one years and under no manner of restraint whatever that this deponent signed the said will as a witness in the presence of the testator and at his request. Goodenow being duly sworn doth depose and say that he was acquainted with Benjamin Wright late of the town of Bergen previous to his death that on or about the seventeenth day of December AD 1838 he saw the said Benjamin Wright sign and execute a certain instrument in writing purporting to be his last will and testament and bearing date the said seventeenth day of December in the year of our Lord, one thousand eight hundred and thirty-eight which is the same instrument now shown unto him that he heard the said Benjamin Wright declare the same to be his last will and testament at the time of the execution thereof that at the time therewof the said Benjamin Wright was at his own dwelling house in Bergen aforesaid of sound mind and memory over the age of twenty one years and under no manner of restraint whatever that this deponent signed the said will as a witness in the presence of the testator and at his request. Goodenow 18th day of March AD 1839 Before me, Ebenezer Mix Surrogate Genesee County Js Jonathan Wright being duly sworn doth depose and say that he received a certain instrument in writing purporting to be the last will and testmanet of Benjamin Wright bearing date seventeenth day of December in the year of our Lord one thousand eight hundred and thirty eight which is the same instrument now shewn unto him of Josiah Pierson and kept in his posession until he delivered it to the Surrogate of Genesee County for Probate. Subscribed and sworn to this Jonathan Wright 18th day of March AD 1839 Before me Ebenezer Mix Surrogate. A Will In the name of God Amen. I Benjamin Wright in the town of Bergen County of Genesee and State of New York being weak in body but of sound mind and memory [blessed be God for the same] do make and publish this my last will and testament in manner and form following [that is to say] Imprimis I give my soul to God and my body to the earth in the blessed hope of a glorious resurrection re-union in form and fashion like glorious body of Christ on whose merits alone I found this hope. 2d I give and bequeath to my beloved wife Susanna, all my household furniture two cows the provisions in the house large Bible or Scotts Bibles as she shall choose and two hundred dollars in money to be paid her by my executor within three months of my decease. 3d I give and bequeath to my daughter Chloe Kelsey nine acres of land on the east end of the south half of lot number ten in the sixth section of town number two of the triangle tract said land to be laid off by a line running through said half lot parallel to the east line thereof. 4 I give and bequeath to my son Jonathan Wright eight acres and 18/100 of an acre of land veing part of lot number 4 in the sixth section of township number two of the triangle tract being a certain piece which I purchased of William Parmelee as by reference to the deed of conveyance will more fully appear.- A also four acres of land in the south half of lot number ten in the sixth section of town number two of the triangle tract to be laid off adjoining the piece bequeathed to Chloe Kelsey on the same lot by a line running parallel to her west line. 5. I give to my son Alfred Wright the remaining twenty-six acres on the aforesaid south half of lot number ten considering it as a reward for fulfilling the stipulations of certain contracts to take care of me and my wife during our natural life. 6. I give and bequeath to my grandson Oren Wright five acres of land situate at the south west corner of the north half of the aforesaid lot number ten being a certain piece conveyed to me by Chandler B. Bigelow and wife as by reference to to said deed will more fully appear. 7th I give and bequeath to the children of my son Hervey Wright so much of the land that I own in lots number two and four in the first section of town number two Triangle tract [reference being had to the deed of conveyance] as lies south of the State road reserving however the use and improvement of the same to the aforesaid Hervey Wright during his natural life and use and improvement of one third of the same to Martha his wife during her natural life should she outlive her husband. 8th I give and bequeath to the children of my daughter Amanda Bigelow deceased a certain lot of land in the state of Michigan which was conveyed to me by Edmond Davis as by reference to the deed of conveyance will more fully appear. 9th. I ordain that a certain piece of land estimate at four or five acres lying on the north side of the State road being part of lots two and four aforesaid be sold by my executors and the avails of the same together with four hundred dollars which I put into their hands for the same purpose be expended at their discretion in building a dwelling house on the land above bequeathed to the children of Hervey Wright and subjected to the same uses. 10th I give and bequeath to my two grandchildren William Wright and Selah M. Wright all my joiner tools to be equally divided between them.- 11th I give and bequeath to Cornelia Crosby Fanny Stone and Clarissa Hubbard the daughters of my son Selah M. Wright deceased each twenty dollars. 12. I give and bequeath to the children of my daughter Amanda Bigelow deceased each twenty dollars.- And I further ordain that if there should be anything of my property left after paying my debts that it be equally divided between my children to wit Sarah Hart, Chloe Kelsey, Jonathan Wright, Hervey Wright and Alfred Wright. And I hereby appoint my to sons Jonathan Wright and Alfred Wright executors of this my last will and testament hereby revoking all former wills made by me. In witness whereof I have hereunto set my hand and seal this seventeenth day of December in the year of our Lord one thousand eight hundred and thirty-eight. Goodenow State of New York Genesee Surrogate Court Be it remembered that on the eighteenth day of March AD 1839 the foregoing instrument in writing purporting to be the last will and testament of Benjamin Wright late of the town of Bergen in the County of Genesee deceased devising real estate and bequeathing personal property was legally proved in the said court before Ebenezer Mix, Esquire Surrogate of our said county of Genesee to have been duly executed by the said Benjamin Wright at the time when the said Benjamin Wright was in all respects competent to devise real estate and bequeath personal property and under no manner of restraint whatever and was then and there admitted to probate. To all which I hereby certify under my official seal and signature at Batavia this 18th day of March in the year of our Lord one thousand eight hundred and thirty-nine. Evenezer Mix, Surrogate.
