Secondly- I give and bequeath to the children of Sarah Hart, the wife of Timothy (initial) Hart, and to the children of Chloe Kelsey the wife of Roger Kelsey, each set of children to be divided equally among them, one third of a certain tract of land lying and being in the town of Riga, County of Monroe and State of New York, and distinguished as the west part of lot number seventy-eight of the West Pultney Tract of land, containing forty-nine acres, as by reference to deed will more fully appear reserving nevertheless to Sarah Hart the use and improvement of such share as shall be let to her children during her natural life and also to Chloe Kelsey the use an improvement of such share as shall be set to her children during her natural life- Thirdly- I give and bequeath to the children of Amanda Bigelow deceased, late the wife of Chandler B. Bigelow, the remaining third of the above described land, and I hereby ordain that the same be sold in the way that the law may prescribe, and that the avails of such sale be placed at interest in such manner as the law in such cases directs, and that the principal and interest accruing thereon be paid over to each of the aforesaid children of Amanda Bigelow respectively, when arrived at the age of twenty-one years. Fourthly- I give and bequeath to my sons (namely) Jonathan Wright, Harvey Wright, and Alfred Wright) each twenty dollars. Fifthly- I give and bequeath to Sarah Hart and Chloe Kelsey each one third of my reaining personal property, and I ordain that the remaining third be converted into money for the benefit of the children of the aforesaid Amanda Bigelow, and that the same be placed at interest, and paid over to each respectively at the same time and in the same manner as above directed concerning the avails of the land, and I hereby appoint my son Jonathan Wright sole executor of this my last will, hereby revoking all former wills and devises by me made, In witness whereof I have hereunto set my hand and seal the twenty- second day of June in the year of our Lord, one thousand eight hundred and forty-four. Goodenow of the town of Bergen, Co. of Genesee State of New York Genesee County Js Be it remembered at a Surrogate Court holden at Batavia in and for the County of Genesee on the eighth day of July in the year of our Lord one thousand eight hundred and forty-four before Timothy Fitch Surrogate of said County, the last will and testament of Susanna Wright of the town of Bergen in said County of Genesee Deceased of which the preceding Record of a Will is a true copy was admitted to be proved and recorded as a Will of Real and Personal Estate, after citation to the heirs and next of kin of the said deceased had been issued, served, returned and filed according to law, requiring them to appear before the said Surrogate to attend the proof of the said will, and after the return and filing the said citation with due proof of the service thereof in the mode prescribed by law, the said will was produced in the said Surrogate Court, before the said Surrogate, and the following depositions of the witnesses was taken to establish the genuineness and validity of the said will for the purpose of having the same proved and Recorded as a Will of Real and Personal Estate. Fitch Surrogate County of Genesee Surrogate Court In the matter of proving the will of Susanna Wright Deceased County of Genesee Js Josiah Pierson of the town of Bergen in the County of Genesee aforesaid, being duly sworn doth depose and say, that on or about the 22nd day of June in the year of our Lord one thousand eight hundred and forty, the said last Will and testament was delivered to this deponent for safe keeping, by Susanna Wright, the Testatrix, and that the instrument now produced and offered for Probate is the same instument which was so delivered as aforesaid, to this deponent, and further this deponent saith, that the said instrument was safely and securely kept by this deponent in his possession from that time until on the 13th day of May in the year of our Lord one thousand eight hundred and forty-four when the said instrument was delivered by this deponent to Jonathan Wright, for safe keeping Subscribed and sworn this 8th day of July, 1844 before me Josiah Pierson. County of Genesee Surrogate Court In the matter of proving the Will of Susanna Wright deceased County of Genesee Js Jonathan Wright of the town of LeRoy, in the County of Genesee aforesaid, being duly sworn, doth depose and say, that on or about the 13th day of May in the year of our Lord one thousand eight hundred and forty-four, the said last Will and testament was delivered to this deponent for safe keeping by Josiah Pierson, and that the instrument now produced and offered for Probate is the same instrument which was so delivered as aforesaid, to this deponent, and further, this deponent saith that the said instrument was safely and securely kept by this deponent in his possession from that time until on the 14th day of May in the year of our Lord one thousand eight hundred and forty-four, when the said instrument was delivered by this deponent to the Surrogate of Genesee County, for Probate. County of Genesee Surrogate Court In the matter of proving the last will and testament of Susanna Wright late of Bergen in the County of Genesee Deceased. County of Genesee Js Josiah Pierson of the town of Bergen in the County of Genesee aforesaid, being duly sworn, doth depose and say, that he is a subscribing witness to the last will and testament of Susanna Wright, late of the town of Bergen, in the County of Genesee aforesaid deceased. And this deponent further saith, that the said Susanna Wright the said deceased, did in the presence of this deponent subscribe her name at the end of the instrument which is now shown and exhibited to this deponent, and which purports to be the last Will and testament of the said Susanna Wright, and which bears date on the 22nd day of June, in the year of our Lord one thousand eight hundred and forty. And this deponent further saith, that the said testatrix, did, at the same time of subscribing her name, as aforesaid, at the end of the said will, declare the said instrument so subscribed, and now exhibited, to be her last Will and testament; and this deponent and George S. Goodenow, did thereupon subscribe their names at the end of the said Will, as attesting witnesses, thereto, in the presence and at the request of the said testatrix. And this deponent further saith, that at the time of this deponent's subscribing his name, as an attending witness thereto, as aforesaid, the said testatrix was of sound mind and memory, of full age to execute a Will, and was not under any restraint. Fitch Surrogate of Genesee County Genesee County Js I Timothy Fitch Surrogate of the said County do hereby certify the preceding to be a true Record of the Will of Susanna Wright, deceased, and of the proceedings, proofs and examinations had and taken thereon, on admittingthe same to be proved and recorded as a Will of Real and Personal Estate, pursuant to the Statute in such case made and provided, and that all the same were Recorded and examined this eighth day of July in the year of our Lord one thousand eight hundred and forty-four. Smith of Cattaraugus County, NY whose will is also posted.
