I John Newell of Greenfield in the County of Greene and State of New York do make this my last Will and Testament hereby repealing all former wills by me in any manner made or executed. 1st I give and devise to my well beloved wife Ruth one Third part of my estate for her use and improvement during her natural life. 2d I give and bequeath to my daughter Miranda the Sum of twenty dollars. 3d I give and bequeath to my daughter Lucina the Sum of twenty dollars. 4th I Give and bequeath to my daughter Ruth the Sum of twenty dollars. 5th I give and bequeath to my daughter Phebe the Sum of one hundred dollars including what she has before had. 6th I give and bequeath to my daughter Sophia twenty dollars. 7th I give and bequeath the remainder and residue of my estate to my six Sons Namely Seth, Asahel, John, Manna, Hart and Jesse to be equally divided between them. It is my will that the Sums above mentioned given to my daughters shall be paid to Them within Twelve Months after my decease by my Executors. And I do Constitute and appoint my two Sons Asahel Newell and John Newell Junr. Executors of this my last Will and Testament. (Greene County} Be it Remembered that on the Ninth day of May in the year of our Lord one Thousand Eight hundred and nine before me Dorrance Kirtland Surrogate of the said County of Greene personally Came Beriah Hotchkin one of the Witnesses to the foregoing Will & being by me first duly sworn made oath that he Saw the Testator John Newell execute the foregoing Instrument & declare the same to be his last Will & Testament in the presence of the said deponent and in the presence of the other witnesses who[m] he saw Subscribe their names as witnesses thereto and that as well he the said Deponent as the other subscribing witnesses Subscribed their Names as witnesses to the said Instrument in the presence of the Testator & in the presence of each other and that the Testator at the time of the Execution thereof was of sound Mind & Memory. And be it further Rem[em]bered that Asahel Newell and John Newell Junr. Executors in the same Will named appeared & were qualified into office the day & year aforesaid. DORRANCE KIRTLAND Recorded May 9th 1809 [There are loose papers relating to the estate of John Newell filed in Box No. 293, Pkg. No. 6690 in the Greene Co. Courthouse. These papers include a detailed inventory and a list of notes held by the testator. In the deposition of Beriah Hotchkin, May 9, 1809, the statement is made that John Newell " ..Died at the town of Greenville (lately Greenfield) in the month of April Last - which was & had been for some years past his place of residence." There are also several items concerning this family in the records of the Presbyterian Church of Greenville, of which Beriah Hotchkin was the founding pastor.]
