Mattice Surrogate of the said county of Greene, according to law, as and for the Last Will and Testament of the real and personal estate of said deceased; which said Last Will and Testament, and the proofs and examinations taken in respect to same, are as follows, to wit: In the name of God Amen. I John Van Wagoner of Durham, Greene County New York being of sound and disposing mind and memory do make publish and declare this my last Will and Testament in manner and from following that is to say First, I direct the payment of all my just debts and funeral expenses and charges. Second, I give devise & bequeath all the rest residue & remainder of my estate property to Joshua G(?) Bortherick of Durham aforesaid in Trust nevertheless for the following uses and purposes for the support & maintanance (sic) of my son William Carey Van Wagoner (now partially helpless, so long as he shall live it being my desire & will that all of the interest or income of said estate be paid over yearly to such Wm. Carry or expended for him in the discretion of said trustee, and in case said interest or income shall be insufficient in the judgment of the trustee for the support of my said son William Carey then said trustee is authorized and hereby directed to expend so much of The principal as may be necessary for his comfortable support in sickness or health confiding in the good judgment of the trustee that said Wm. Carey will be but not improvidently cared for. Third, On the death of my said son William Carey I direct my said Trustee to pay over any surplus of said estate should there by any remaining after all funeral charges and expenses are paid of said William Carey to my daughter Martha Campbell wife of Ralph Campbell to whom I give and bequeath the same and to her heirs and assigns forever. Lastly, I do hereby constitute and appoint said John G. Bortherick, Executor of this my last Will and Testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal this twenty third day of March in the year of our Lord one thousand eight hundred-and seventy seven.
