I John Osterhout of the town of Warren in the county of Herkimer being of sound mind, memory and understanding blessed be God for the same do hereby make and publish this as so for my last will and testament in (?) of the following Virg Lind? I do hereby give leave and bequeath that unto my son Frederick Osterhout all my soil estate situate lying and being in the town of Warren and County of Herkimer and all my personal estate of every name and nature to have and to hold to him his heirs and .. I do hereby give, devise and bequeath unto Jacob Knants the farm whereon he now lives estate lying and being in the town of German Flatts to hold to him and his heirs and ? forever subject to the ? herein after mentioned. Thirdly I do hereby devise and bequeath order and direct that my said son Frederick do pay and deliver to my beloved wife out of the real and personal estate herein devised to him yearly and every year during her natural life fifteen bushels of wheat, eight bushels of corn, two pounds of tea, fifty pounds of sugar and that he furnish her during her life with a good room in the house wherein I now live and necessary bed and bedding & clothing & all necessary fire and wood and that he furnish and keep for her life use and good care during her said life. Fourthly, I do hereby devise bequeath as do direct that Jacob Knauts pay out of the real estate devised to him within three years after my death to Jacob Judson forty even dollars, to William Hagerdorn (spelling ?) one hundred dollars and twenty dollars, to John Shave (spelling ?) one hundred and fifty dollars and to Sarah Hagerdorn daughter of William Hagerdorn twenty five dollars, the last sum to be put at interest by my executor herein after named and not to be paid to the said Sarah until she arrives at the age of sixteen years. Fifthly I do further devise bequeath give order and direct that my said son Frederick do maintain and support my sons John and son Augustus during their natural lives in all necessary materials dress lodging & clothing in the same manner as I have heretofor supported them out of the real and person at estate herein devised to him. Sixthly I do hereby make, constitute and appoint Levi Blankly of the Town of Warren, Conrad Help (sp?) of the Town of German Flatts and my said son Frederick to be executors of this my last will and testament hereby revoking all former wills and one made in witness whereof I leave here unto with my hand and seal this eighteenth day of November, one thousand eight hundred and seventeen. KNOW YE THAT, at Herkimer in said County on the twentyth day of April in the year One thousand one hundred and eighteen before Alijah Lambling, Esquire Surrogate in and for said county, the will and testament of John Osterhout late of said county deceased, a true copy whereof is annexed, was proved, and now is approved and now is allowed of by us; and the deceased having whilst he lived and at the time of his death goods, credits and chattels, within this state by means of approving and registering the said will and granting administration of the said goods, chattels and credits, and the auditing and allowing the following discharging the account thereof doth belong unto us: the administration of all and singularly said goods chattels and credits of the said deceased, and every way concerning the said deceased, and every way concerning the said will, is granted to: Seely Blatchly, Conrad Hep and Frederick Osterhout, the executor in the said will named, they being first duly sworn well and faithfully to administer the same and just and true inventory of all singular the goods, chattels and credits to make and exhibit into the office of the said Surrogate, within six calendar months from the date hereof, and to render a true account thereof when thereunto lawfully required: In testimony whereof, we have caused the seal of the office of our said Surrogate to be hereunto affixed. Mesuch, Anthony Devoe, Cornelius Devoe the subscribing contemps to the last will and testament of John Osterhout deceased who being duly sworn, deposed and said that they saw him, the testator sign seal and publish the forgoing as his last will and testament and that he appeared to be of sound deposing mind and memory.
