Holmes are subscribing witnesses to the last Will and Testament of Melinda Dominick late of the town of Little Falls in the said county of Herkimer deceased. And this deponent further says that the said deceased did in the presence of this deponent & Charlotte A. Holmes subscribe her name at the end of the instrument which is now shown to this deponent and which purports to be the last Will and Testament of the said deceased and which bears date on the 19th day of September AD 1864; that the said deceased did at the time of subscribing her name to said instrument as aforesaid declare the same to be her last will and testament; that this deponent and the said Charlotte A. Holmes did thereupon subscribe their own names at the end of said instrument as attesting witnesses to the execution thereof at the request of the said deceased and in her presence and in the presence of each other. That the said deceased at the time of subscribing her name to said instrument as aforesaid was upwards of twenty-one years of age that she appeared to be of sound mind and was not under restraint to the knowledge or belief of this deponent. Charlotte Holmes Sworn examined and subscribed this 25th day of May 1872 before me Amos W. Prescott Surrogate County of Herkimer Surrogate s Court -- In the matter of proving the last Will and Testament of Melinda Dominic deceased Herkimer County ss: Charlotte A. Lewis formerly Charlotte A. Holmes now of the City of Rochester in the county of Monroe being first duly sworn in open Court on her oath does depose and say that deponent and Charlotte Holmes are subscribing witnesses to the last Will and Testament of Melinda Dominic late of the town of Little Falls in the said county of Herkimer deceased. I, Melinda Dominick of the town of Little Falls in the County of Herkimer and State of New York of the age of (64) sixty Four years, and being of sound mind and memory do make publish and declare this my last will and testament in manner following that is to say: I give and bequeath to my Daughter Katharine Mary Dominick the sum of (1000) one thousand dollars To my Daughter Amanda Perry the wife of Whitby Hunting the sum of (500) Five Hundred Dollars To my son Edward Dominick the sum of (500) Five Hundred Dollars To my son George Dominick the sum of (1000) one thousand dollars I give and bequeath to my son John Herkimer Dominick the sum of (1000) one thousand dollars. And I farther direct the above sum of one thousand dollars placed by the Executor of this my last will and Testament upon Interest upon Bond and Mortgage for the term of (5) Five years after my death at the expiration of which or such time should said John Herkimer Dominick not be found he now at the Execution of this being absent and his residence not known or known to be dead and the said (1000) one thousand dollars not having been claimed by him the said (1000) one thousand with the interest for the Five years accruing on the same shall be equally divided between my Children Weidman Edward Katharine and Amanda. I also give and bequeath to my Daughter Katharine all my household Furniture. To my Daughter Amanda all my wearing apparel and lastly I give and bequeath the rest residue and remainder after purchasing and Erecting tomb stones at my grave and the payment of the or for the same from said remainder shall be divided equally between my Children Weidman Dominick Edward Dominick Katharine Mary Dominick and Amanda Perry Dominick the wife of Whitby Hunting. In witness whereof I hereunto set my hand and seal this nineteenth (19) day of September in the year of our lord one thousand eight hundred and sixty four. Melinda Dominic Sept. 19th 1864 The above instrument consisting of three pages was at the date signed sealed published and declared by the said Melinda Dominick as and for her last will and testament in presence of us who at her request and in her presence and in the presence of each other have subscribed our names as witnesses thereto. Holmes Palmyra Wayne County Charlotte Holmes Palmyra Wayne County State of New York Herkimer County Surrogates Office SS: Be it remembered that on the 29th day of June AD 1872 the last will and testament of Melinda Dominick late of the town of Little Falls in said county of Herkimer deceased bearing date the 19thday of September AD 1864 (being the annexed written instrument) was duly proved before Amos H. Prescott Surrogate of said County of Herkimer according to law as and for the last will and testament of the real and personal estate of said deceased; which said last will and testament and the proofs and examinations taken thereon are recorded in this office in Book P of Wills on page 281 and following. In testimony whereof I Amos H. Prescott Surrogate of said County have hereunto set my hand and seal of Office at the Surrogates Office in the village of Herkimer this 29th day of June AD 1872.
