In the matter of proving the last Will and Testament of George Fulmer, Deceased. Herkimer County,SS: Hubbard H. Morgan of the town of Herkimer, in the County of Herkimer being first duly sworn in open court on his oath does depose and say that this deponent and Abraham Witherstine are subscribing witnesses to the last Will and Testament of george Fulmer deceased late of the town of Columbia in the said County of Herkimer deceased. And this deponent furthur says that the said deceased did in the presence of this deponent is said Abraham Witherstine subscribe his name at the end of the instrument which is now shown to this deponent and which purpose to be the last Will and testamentof the said deceased and which bears date on the 28th day of August- A.D. 1858, that the said deceased did at the time of subscribing his nameto said instrument-as aforesaid declare the same to be his last Will and testament that this deponent and the said Abraham Witherstine did there upon subscribe there own names at the end of said instrument as attesting witness to the execution there of at the request of the said deceased and in his presence and in the presence of each other. That the saiddeceased at the time od subcribing his name to said instrument as foresaid wasupwards of twenty one years of age; that he appeared to be of sound mine and memory and was not under restraint to the knowledge or belief of these deponents. Sworne examined and subsribed} H.H Morgan this 4th day of march 1872 before me Amos H. Prescott Surrogate- County of herkimer Surrogate Court. In the matter of proving the last-Will and testament of George fulmer- Deceased. Herkimer County-ss Christoher C. Witherstine of the town of Herkimer in the county of herkimer being duly sworn and examined in open court before Amos H. Prescott Surrogate of Herkimer County doth depose and say that he was well acquainted with Abraham Witherstine late of the town of Herkimer in the County of Herkimer deceased and with his manner and style of handwriting having often seen him write and that he verily believes that the signature Abraham Witherstine signed as a witness to the instrument in writting now produced and shown to this deponent bearing date on the 28th day of August-A.D.1858 purposing to be the last Will and testament of george Fulmer desceased is the true and genuine handwriting and signature of the said Abraham Witherstine and deponent furthur says that the said Abraham Witherstine was deceased Christopher Witherstine Sworn examined and subscribed before me this 4th day of March A.D 1872 Amos H. Prescott Surrogate Will I George Fulmer of Columbia in the county of Herkimer, being in sound mine and memory calling to mind the uncertainty of this life and that it is appointed for all men once to die and being desirous to make a disposition of my Worldly Estate do hereby make this my Last Will and testament- and do hereby dispose of my worldly estate and effects as follows- First- I order and direct that out of personal estate my Executers herein after named shall pay all my just and lawful debts and funeral charges. Second- I give and bequeath unto my my beloved wife Catherine Fulmer all my cows and sheep and all my beds, bedsteads and bedding and a suitable support and maintainace in sickness and in health the said support and maintaince except medicine and medical attendence is to be furnished to and provided for her by my son John G Fulmer out of the estste herein after devised and bequeathed to him. I hereby give and bequeath to my wife Catherine also during her widowhood the interest and use of all the moneynotes and money obligations of which I may die possesed the owner the said moneynotes and obligations to be subject to the control of my executors herein after named and which said money notes and money obligations the said executors shall keep invested for the use of said wife and on her decease if so long she shall remain my widow or in case of her remarriage then on the event of such remarriage the money and said notes and money obligations and avails and increase of the same. I hereby give and bequeath and order and direct my said Executors to pay over the same to my son John G. Fulmer, my daughters Nancy Cristman and Betsey Myers and the children of my deceased daughters Catherine Manning Emaline Geturan and Almiria Youngs in equal one sixths that is to say one sixth to the said John G. Fulmer and one sixth to each of my said daughters Nancy Cristman and Betsey Myers one sixth, one sixth to the children of my deceased daughter catherine Manning and one sixth to the children of my deceased daughter Emaline getman and one sixth to the children of my deceased daughter Almiria Youngs. Third- I devise and give to my son John G. fulmer all and singular the farm and lands on which I and the said John G. Fulmer and our families are now living in the town of Columbia and county of Herkimer to have and to hold the same to the said John his heirs and assigns subject to the payment of the said legacies herein after bequeathed and mentioned I do hereby give and bequeath unto my son John also all and singular any other lands and real estate whatsoever and where so ever situated and also all and singular my personal estate and property- not herein before or herein after bequeathed and mentioned. Fourth- I give and bequeath to each my daughters Nancy Ctistman and betsey Myers each the sum of one hundred and fifth dollars to the children of my deceased daughter Catherine Manning deceased collectively the sum of one Hundred and fifty dollars to the two children of my deceased daughter Emiline Getman together the sum of one hundred and fifty dollars and to my grandson George Young the sum of fifty-dollars and to my granddaughter Bianca Edisk five dollars the said george and the said Bianca being the children of my deceased daughter Alviria Young and all the legacies in this fourth devise mentioned and bequeath I hereby charge upon the estate devised to any said son John G. fulmer and which I hereby order and direct to be paid by him my said son John at the end of three years from the date of my decease. Fifth- I give and bequeath to my grandson George Washington Fulmer my interest and property in and to a certain thrashing machine a sawing machine and a clover seed machine held and owened by myself in comman with my son John G. Fulmer and Jabes Rofs. Lastly I do hereby constitute and appoint my son John G. Fulmer and my friend Jacob Ackler Junior Executors to this my last Will and Testament and authorize them to take possession and charge of the money notes and money obligations that I may leave at my death and collect the said notes and monet obligations avest the same and from time to time collect and invest the same in order to keep the same secure and to pay over annually or oftener if oftener. They shall receive the same the interest and use of the said money notes and obligations to my said wife Catherine as herein before provided and on the death or remarriage of my said wife to pay over the said moneys and notes and obligations in equal one sixths as herein before in the second devise provided and mentioned. In witness whereof the said george Fulmer the said testor has hereinto set his hand and seal this twenty-eight day of August one thousand eight hundred and fifty eight. State of New York Herkimer Co.Surrogates Office ss Be it remembered that on the fourth day of march A.D.1872 the last Will and Testament of george Fulmer late of the town of Columbia in said County of Herkimer deceased bearing date the 28th day of August A.D. 1858 ( being the ammended written instrument) was dulypresent before Amos Prescott Surragate of said County of Herkimer according to law as and for the last Will and Testament of the real and personal estate of said deceased; which said last will and testment and the proofs and examinations taken thereon are recorded in this office in Book P on page 226 and following.
