Will of Daniel Garlock

COUNTY OF HERKIMER, NY --- SURROGATE'S COURT

IN THE MATTER OF PROVING THE LAST WILL AND TESTAMENT OF

Daniel Garlock, Deceased

Herkimer County, ss.

William G. Schermerhorn of the town of Conneaut in the county of Crawford and 
State of Pennsylvania being first duly sworn in open Court, on his oath does 
depose and say that he and Wm. B. Wright & Phineas B. Carpenter are the 
subscribing witnesses to the last Will and Testament of Daniel Garlock, late
of the town of Russia, formerly of Conneaut aforesaid in the said county of 
Herkimer, deceased.  And said Wright & Carpenter and these deponents further
says that the said deceased did, in the presence of these deponents subscribe
his name at the end of the instrument which is now shown to this deponent and
which purports to be the last Will and Testament of the said deceased, and
which bears date on the 29th day of March A. D. 1866; that the said deceased
did at the time of subscribing his name to said instrument as aforesaid,
declare the same to be his last Will and Testament; that this deponent & said
Wright & Carpenter did thereupon subscribe their own names at the end of said
instrument as attesting witnesses to the execution thereof, at the request of
the said deceased, and in his presence, and in the presence of each other. 
That the said deceased at the time of subscribing his name to said instrument
as aforesaid was upwards of twenty-one years of age; that he appeared to be of
sound mind and memory, and was not under restraint to the knowledge or belief
of the deponents.  That said Wright & Carpenter and each residents of the
State of Pennsylvania.

Herkimer County, ss.

     Levi F. Carpenter of the town of Russia in the County of Herkimer, being 
duly sworn and examined in open Court before Amos H. Prescott, Surrogate of 
Herkimer County, doth depose and say that he was well acquainted with Phineas
B. Carpenter of the town of Conneaut in the County of Crawford, Pennsylvania
and with his manner and style of handwriting, having often seen him write, and
that he verily believes that the signature "P. B. Carpenter" signed as a
witness to the instrument in writing now produced and shown to this deponent,
bearing date on the 20th day of March A. D. 1866 purporting to be the last
Will and Testament of Daniel Garlock, deceased,  is the true and genuine
handwriting and signature of the said P. B. Carpenter and deponent further
says that the said P. B. Carpenter is now a resident of the State of
Pennsylvania.

In the name of God, Amen.  I, Daniel Garlock of the township of Conneaut in
the County of Crawford, State of Pennsylvania, former, being weak in body and
of sound mind and memory and understanding, praised be God for the same, do
make this my last Will and Testament in the manner and form following:

I give and devise and bequeath to my beloved wife, Sophronia Garlock, her
heirs and assigns forever all my property real personal and mixed of whatever
nature or kind and wheresoever the same may be at the time of my decease,
whether in this State or otherwise.

And I do nominate, constitute and appoint my said wife, Sophronia Garlock, and
P. B. Carpenter, my executors of this my last Will and Testament hereby
revoking and making void all and every other will or wills at any time
heretofore by me made and do declare this to be my last Will and Testament.

In witness whereof, I, Daniel Garlock, have hereunto set my hand and seal this 
twenty-ninth day of March A. D. 1866, Signed sealed and delivered and
published by the above named Daniel Garlock as and for his last Will and
Testament in the presence of us who at his request and in his presence have
subscribed our names as witness thereto

Be it remembered, that on the 22nd day of May A. D. 1876, the last Will and 
Testament of Daniel Garlock late of the town of Russia, in said County of 
Herkimer, deceased, bearing date the 29th day of March A. D. 1866, (being the 
annexed written instrument,) was duly proved before Amos H. Prescott,
Surrogate of said County of Herkimer, according to law, as and for the last
Will and Testament of the real and personal estate of said deceased which said
last Will and Testament and the proofs and examinations taken thereon, are
recorded in this office in Book R of Wills, on page 123 and following.

     In testimony whereof, I, Amos Prescott, Surrogate of said County
     have hereunto set my hand and seal of office, at the Surrogate's office
     in the village of Herkimer, this 22nd day of May A. D. 1876.

I, Amos H. Prescott, Surrogate of Herkimer County, do hereby certify the 
foregoing to be a true copy and record of the last Will and Testament of
Daniel Garlock late of town of Russia in said county, deceased, propounded and
duly proved before me, and also of the proofs and examinations taken before me
in relation thereto.

Witness my hand at Herkimer, in said county, this 22nd day of May A. D. 1876.
