IN THE MATTER OF PROVING THE LAST WILL AND TESTAMENT OF PETER BARRUP, DECEASED. HERKIMER COUNTY, SS.: F__________ Ouderkirk of the town of Ohio in the county of Herkimer and Fred A. Miller of the town of Ohio in the county of Herkimer State of New York being each duly sworn, do depose and say, the said F----- Ouderkirk for himself that he is a subscribing witness to the last Will and Testament of Peter Barrup late of the town of Ohio in said county of Herkimer, deceased; and the said Fred A. Miller for himself that he is a subscribing witness to the last Will and testament of said Peter Barrup late of the said town of Ohio in said county of Herkimer, deceased; and that the said deceased did on the 21st day of August 1888, in the presence of these deponents, subscribe his name at the end of the instrument which is now shown to these deponents, and which purports to be the last Will and Testament of the said deceased, and which bears date on the 21st of August 1888; that the said deceased did at the time of subscribing his name to said instrument as aforesaid, declare the same to be his last Will and Testament; and these deponents did thereupon subscribe their own names at the end of said instrument as attesting witnesses to the execution thereof, at the request of said deceased, and in his presence, and in the presence of each other. That said deceased at the time of subscribing his name to said instrument as aforesaid, was upwards of twenty-one years of age; that he appeared to be of sound mind and memory, and was not under restraint to the knowledge or belief of these deponents. Miller Peter Barrup I Peter Barrup of the town of Ohio the county of Herkimer and state of New York being of sound mind and memory do make, ordain, publish and declare this to be my last Will and Testament. That is to say: First-After all my lawful debts are paid and discharged, I give devise and bequeath to my daughter Laura Barrup all my household furniture and beds except one good feather bed, quilts and sheets for same, which I reserve for my son Erwin. I further give to my daughter Laura six hundred and fifty dollars the sum to be paid her when there is money paid on any of my Mortgages to do so providing she needs or wants the same before there is enough due and paid on the Mortgage to pay the whole amount of six hundred and fifty dollars. To my son Erwin Barrup the feather and above mentioned, and six hundred and fifty dollars. I direct that Five hundred dollars of any available cash be invested in United States Bonds if I have not done so before my death. The same I give and bequeath to my son Erwin. The above money I direct that to be paid him when he arrives at the age of twenty one years. If my son should be sick or need any money besides for necessary purposes, the same may be paid him out of the _______ of my personal property that may remain after my death. I direct that the same be turned into cash and together with what money may be on hand after paying my funeral expenses be divided equally share and share alike. I give to my son the yearling colt which I direct not to be sold, but if it is necessary to sell him then proceeds thereof to be given to my son for his necessary purposes before his arriving at the age of twenty one years. Likewise I make ________ and appoint Charles G. Wood of Ohio _____ to be Executor of this my last Will and Testament hereby revoking all former Wills by me made. In Witness Whereof I have hereunto subscribed my name and affixed my Seal the 21st day of August in the year of our Lord one Thousand eight hundred and eighty eight. The above instrument consisting of one sheet was at the date thereof subscribed by Peter Barrup in the presence of us and each of us he at the time of making such subscription acknowledged that he made the same and declared to said instrument as subscribed by him to be his last Will and Testament. BE IT REMEMBERED, That on the 15th day of October A.D., 1888, the last Will and Testament of Peter Barrup late of the town of Ohio, in said county of Herkimer, deceased, bearing date the 21st day of August A.D., 1888. (being the annexed written instrument,) was duly proved before ROLLIN H. SMITH, Surrogate of said County of Herkimer, according to law, as and for the last Will and Testament of the real and personal estate of said deceased, which said last Will and Testament and the proofs and examinations taken thereon, are recorded in this office in Book Y of Wills, on page One and following. IN WITNESS WHEREOF, I, ROLLIN H.
