Vol. Z page 43 In the name of the God Amen; I James M Caldwell of the town of Schuyler in the county of Herkimer the State of New York. Do make publish and declare this to be my last will and testament in manner following [wit]. Firstly after all my lawful debit are paid I give devise and bequeath unto my wife Louisa Caldwell all notes, money, bonds and mortgages, except the sum of $2000. Also all the house hold furniture she same during her natural life time. Secondly I give and bequeath unto my son Jerome M. Caldwell the sum of $500 and 12 cows also the Hazleton farm of about 81 acres of land for and during his natural life and his death the same to go to his first. Thirdly I give devise and bequeath to my son J. Minott Caldwell the sum of $500 and all the stock , farming tools and other personal property not herefore bequeathed to my wife, which shall be and remain on the farm his owe as have farm[where I now reside] at the time of my death. Also to him and his hire forever I give and devise the said house, farm of about 233 acres subject however to the payment by him to my daughter Mary J. Wiegand and Helen L. Farrington of the sum $2500 each the same to became due and payable as follow $1250 each two years after my death and $1250 each four year after my death with interest annually at the rate of 4% per annual. Interest to begin to run one year after my death and the said payment of $2500 each to my said daughter is hereby made charge these the land to bequeathed to my son J. Minott Caldwell. Fourthly I give devise and bequeath to my daughter Mary J. Wiegand and Helen L Farrington the sum of [$500] first hundred dollar each the same payable one year after my death. Fifthly I hereby make and appoint my wife Louisa Caldwell sole executive of this my last will and testament at the same revoking all former wills by me made. Done at Schuyler this 28th day of May 1888. James M Caldwell [Seal] The forgiving instrument consisting of one sheet of legal {?} signed, sealed, published and declared by she said testator to be his last will and testament in our presence and he at the same time requested we to sign the same as witnesses thereof in his presence and we did so sign the same at his request and in his presence and in the presence of each other J.D. Henderson residing at Herkimer, N.Y. Char. C Edmund Jr. residing at Herkimer , N.Y. Be it remembered that on the 22 day of September AD 1890, the last will and testament of James M. Caldwell late of the town of Schuyler, in said county of Herkimer, declared hearby date the 28 day of May AD 1888 [being the annexed written instrument] were duly sworn before Eugene E. Sheldon, Surragate of said County of Herkimer, acorrding to law ,as and for the last will and Testament of the real and persanal estate of said deceased, which said last will and Testament and the proof and examination tooken then, are recorded in this office in Book J of Will on page 43 and following. In Testamony whereof, I Eugene E. Sheldon Surrogate of said County, sgin there unto set my hand and seal of office, at the Surrogatic office in the village of Herkimer, this 2 day of September AD 1890. - L.S. Caldwell late of the town of Schuyler deceased, with the record of the original or recorded in Book Z of Wills, page 43 in this office, deed that the same in a correct transcript thereof and of the whole of such record. And I furhter certify, That said Will were duly admitted to Probate before the Surrogate of the County of Herkimer, on the 22 day of September 1890, as a Will valid to part real and personal estate.
