COPY LAST WILL AND TESTAMENT OF SAMUEL LUFF The People of the State of New York by the grace of God free and independent to all whom these presents shall come or may concern send greetings- Know ye that at Adams in the County of Jefferson before Lyman MUNSON Esquire, Surrogate of our said County the last will and testament of Samuel LUFF, deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us. And the said deceased having whilst he lived and at the time of his death Goods Chattels and Credits within this State – by means whereof the Granting Administration of all and singular the said Goods Chattels and Credits and final discharging the amount thereof doth belong unto in the Administration of all and singular the goods chattels and credits of the said deceased and any way concerning his will is, granted to Edmund LUFF, John SARGENT and Nehemiah GALE executors in the said will named – They being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the said Goods Chattels and Credits and also to render a just and true account thereof when thereunto required – In Testimony thereof we have caused the seal of office of our said Surrogate to be hereunto affixed --- Witness Lyman MUNSON Surrogate of the said County at Adams the Twenty Sixth day of August in the year of our Lord one thousand eight hundred and twenty two and of our Independence the forty-seventh year – Signed Lyman Munson Recorded August 26, 1822 Surrogate (LE Note: paragraph breaks added for clarity) COPY OF WILL The last will and testament of Samuel LUFF of the Town of Hounsfield County of Jefferson and State of New York made the Nineteenth day of July in the year of our Lord One Thousand Eight Hundred and twenty two in the name of God Amen – I Samuel LUFF being of sound mind and memory do give my money and land in the following manner – I give unto Sarah my wife as much housel goods as she wants with two beds and covering compete – and the lot of land late Robert ADAMS – with the buildings on it – she to have it the time of her life on the Muscalonge Creek 14 acres in said Town – also I give her the lot of land late Elbrige POTTER on the south Brownville Road from Sackets Harbor in said Town containing 21 acres the time of her life – and more hereafter from the lots of land – I give my beloved Daughter, Laura LUFF, by said wife, two Hundred dollars in money when eighteen years of age this a dividend from son Sam LUFF’s money the mother to take the interest to buy her clothing – I give my daughter Laura LUFF after her mother’s death the lot of Land late Elbrige POTTER’s as above to her and her heirs both the above lots if she has no heirs after her death to go to my children hereafter named– To my son Edmund LUFF of Sackets Harbor and County of Jefferson I give the grist mill and all the land north of the mill road 2 acres with the mill creek and Horse shed he to pay my wife thirty dollars a year as long as she lives and after her death he to pay his sister Rachel KINGSBURY of said Town one Hundred dollars – I give my son Edmund LUFF all that note dated June 1st, 1817 and all the interest on it due -- I give Jessie (sic Jesse) LUFF that lot of land late Azel POWERs on the Muscalonge Creek above the town containing 61 acres he to have it the time of his life and after his death to go to his heirs – if he has no heirs to go to my family hereafter named at his death – I give him one hundred dollars fifty in money and fifty in land produce and the money I paid for him to Sam HOOKER is to be offset out of it as per receipt $33 -- if he becomes a sober man my executors may given to him one hundred dollars more if they in their judgment think him reformed The said Jessie is to let his mother cut ten cords of wood early if she wants of his lot – I give unto Joseph LUFF all the lot north of Mill Creek where his saw mills stands containing 110 ½ acres in said Town he to pay his mother my wife ten dollars a year the time of her life the above lot is taken of great lot No. 52 now in subdivision lot No.2 on the south part touches the road leading from Sackets Harbor to Brownville - I give Joseph LUFF all the interest due on the lot – that piece sold to Mr. STONE for $100 – is to be paid me as Joseph left the contract with me for that intent – I give unto my daughter Mary wife of Jack ROOTS the six hundred on a mortgage on Anthony WATSON’s land for her to have the interest of it the time of her life all the Back interest to come to me and after her death to go equal to her children by both husbands –if the Land is sold or money paid in my Will is to have it put in the Utica Bank and for her to have the interest paid her –The said land is in the above Town -- The said Mary is to pay my wife six dollars yearly -- If I do have any lands over Black River Bay of Samuel HOOKER and do give the said Mary her portion there instead of WATSON land then the $600 – on WATSON’s land to be divided as hereafter mentioned – I give unto my daughter Susannah the wife of John SARGENT all that lot of land late Amos WHITCOMB’s in the above town joining the new road from Sackets Harbor to Brownville containing 63 acres -- I give it her the time of her life and after her death to all her children equally - the said Susannah is to pay my wife Eight Dollars a year the time of her life— I give unto my daughter Rachel KINGSBURY of Hounsfield the Mill House and Barn all the buildings south of the road except the Horse shed that belongs to the mill - I give her all the land south of the road and stone wall Gardens Orchard all in the above town this land is taken of great lot N. 52 subdivision lot No. 1 – containing about twenty five acres more or less – and the said Edmund LUFF is to pay the said Rachel KINGSBURY after her mother’s death one hundred dollars – moreover give the above Rachel after my death one hundred dollars in money the said Rachel is to pay my wife six dollars a year – if my wife wishes to have one room in the mill house she is to have it and some fruit as much as she wants to eat and a small bit for a garden if she wants -- after Rachel KINGSBURY’s death the mill Land to be given to her son Edward SLOMAN and Harriet SLOMAN her daughter as the mother thinks right and best to give it – The contract to William SARGENT my wife to have the interest of it the time of her life – But if she marry again I give her the Housewell only – and no more – I give unto my daughter Sarah of Smarden (Kent) Great Britain lately Sarah MOTT I give her one hundred and twenty pounds sterling the money is in the hands of Wm. BURGIS Battenmaker Cranbrook Kent Great Britain -- some of that son Samuel’s money and all the money in Great Brittain and here not mentioned above to be divided into seven equal shares Edmund LUFF’s children one share – Jessie LUFF’s children one share – Joseph LUFF’s children one share – and Mary’s children by both husbands one share – Susannah’s children one share – Rachel’s children one share – Laura LUFF’s one share Them girls children not of age the money to be paid to their mothers to keep for them or if their executors think best to put it into the Utica Bank until of age -- I give a small watch to Laura LUFF -- my watch to Edward SLOMAN -- my gun to Charles MITCHEL -- my wife to have one cow -- my desires to be interred in the burying ground near the Harbor the burying ground of Edmund LUFF’s and Red cedar Posts and Rail the same as son Samuel’s to be put up to be done by John SARGENT and I hope through the mercy of God and by the Mediation of Jesus who said I am the Resurrection and the Life to have an admittance into his everlasting Kingdom where pain and sorrows shall be done away -- My desire is to have the remains of my son Samuel removed and laid by me -- My wife is Knowing of my property in Great Brittain she will say to the executors about it -- and I hereby revoke all former wills made by me at any time Ratifying and conforming this to be my last will and testament - and I hereby appoint my son Edmund LUFF and Nehemiah GALE farmers of this town and John SARGENT my true and lawful executors of this my last will and testimony and for their trouble I give them forty dollars each and they are not to make good any money that may be lost by accident – Signed sealed Published and Declared in the presence of these who have subscribed their names as witnesses the day and date above mentioned – SAM’L LUFF (L.S.) Witness Daniel HARLOW Tho’s HALL, Jr. William SARGENT Additional Comments: 1. Edmund Luff was Samuel’s oldest son and second child. John Sargent was Samuel’s son-in-law, married to his daughter Susannah. 2. Samuel Luff was a miller born in Cranbrook, Kent, England in 1753. He and his family lived in Sussex before coming to New York in late 1805. He built mills north of Sackets Harbor village on Mill Creek, had farms from Sackets Harbor north to the Black River, and retained some properties in London and Sussex. “Memories of Harriet Sloman Walling”, as told to Anna Walling Day, c.1895, private papers, Charles Wardwell. This was the source of much of the material about the children, supported by censuses. 3. Sarah Colbran/Corforan was Samuel’s second wife. They were married in England before coming to the U.S. His first wife was Sarah Parker, who probably died before 1800. She was the mother of all the children but Laura, the ninth child of Samuel Luff. 4. Samuel, Jr., the second son and fifth child, had died by the time his father’s will was prepared July 19, 1822. 5. Jesse was the third son and sixth child. Sam Hooker refers to Samuel Flier Hooker, a major shipper and landowner in town. 6. Joseph was the fourth son and seventh child. 7. Mary was the second daughter and third child. Her husband was John/Jack Roots, also a native of England. 8. Susannah was the fourth daughter and eighth child. Her husband John Sargent was one of the executors of Samuel’s will. 9. Rachael was the third daughter and fourth child. Her first husband George Sloman, also from England, died in 1810. Sarah was the first daughter and first child. She was the only one of Samuel’s children to remain in England. In 1798 she had married Benjamin Mott of Smarden, Kent. (Canterbury Marriage Licenses 1788-1809, Vol 33, Folio 165 - 1799.) Their first child was named Benjamin.
