Courthouse, Watertown, NY Will Book Vol. 34, page 387 THE LAST WILL AND TESTAMENT OF Jane Roy deceased BE IT REMEMBERED, That heretofore, to wit: on the 24th day of March in the year of our Lord one thousand eight hundred and ninety six Claude L Tucker of the Town of Lorraine Jefferson County NY the Executor named in the last Will and Testament of Jane Roy late of the Town of Lorraine in the County of Jefferson, deceased, appeared in open Court before the Surrogate of the County of Jefferson and made application to have the said last Will and Testament which relates to both Real and Personal Estate, proved; and on such application the said Surrogate did ascertain by satisfactory evidence who were the heirs at law and next of kin of the said testator, and their respective residences, and they are as follows, viz: Edward Harvey Nephew residence unknown Lydia Pratt Niece of Croghan Lewis County N.Y. William LaMoitt Nephew of Lorraine Jefferson County N.Y. Eva C. Smith Grandaughter of Oswego Oswego County N.Y. Pearl Cavalier GrandSon of " " " " Frank Cavalier " " " " " " Roy Cavalier " " " " " " and said Surrogate did thereupon issue a citation in due form of law, directed to the heirs of law and next of kin by their respective names, and requiring them to appear before said Surrogate at his office in the City of Watertown, in said County, on the 11th day of May A.D., 1866, to attend the Probate of said Will and afterwards to wit: on the 11TH day of May A.D. 1896 Satisfactory evidence by affidavit was produced and presented to said Surrogate of the due services of said Citations in the mode provided by Law & said Surrogate having duly appointed Harold L. Hooker Atty at Law of the City of Watertown N.Y. Special Guardian of Pearl Cavalier, Frank Cavalier and Roy Cavalier, minors duly served with the citation and said Special Guardian having immediately appeared before said Surrogate and on that day, no one appearing to oppose the probate of such Will such proceedings were thereupon had in said Court afterwards, that the said Surrogate took the proofs of said Will hereinafter set forth, upon this 11th day of May A.D. 1896 and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate, and the proofs thereof to be sufficient, which said Last Will and Testament and proofs, are hereinafter recorded in this book. Adams Surrogate Jane Roy's Estate Will The Last Will and Testament of Mrs. Jane Roy of the Town of Lorraine County of Jefferson and State of New York, I Jane Roy do make, order, publish and declare this to be my last Will and Testament, in manner and form following, that is to say: First, to provide for my funeral expenses and burial and secondly to provide for a suitable head stone for myself and husband to be erected on our lot in the cemetery in Oswego, NY and Thirdly to pay all my debts and fourthly to bequeath to my grandaughter Mrs. Chas Shaw fifty dollars ($50) and to my grandson Fred Hotchkiss fifty dollars ($50) they both being residents of Fall River Mass. and I bequeath the balance of all my personal and real estate of every name and nature to my nephew William LaMoitt who now resides with me at my home in Lorraine N.Y. Likewise, I make, constitute and appoint Claude L. Tucker of Lorraine N.Y. with full power to convey all of my real estate to cary out this my last will and testament, to be the executor of this, my last Will and Testament, and I hereby revoke all former Will by me made.
