Be it Remembered. That heretofore, to wit: on the 7th day of February in the year of our Lord 1863 Jane Edner of Wilna, Jefferson County, New York, legatee named in the Last Will and Testament of George S. Ingraham late of the town of Antwerp in the County of Jefferson, deceased, appeared in open Court, before the Surrogate of the County of Jefferson and made application to have the said Last Will and Testament, which relates to both Real and Personal Estate, proved: and on such application the said Surrogate did ascertain by satisfactory evidence who were the widow heirs at law and next of kin of the said testator and their respective residences, and that they are as follows to wit: Sally Ingraham widow of said deceased of Antwerp aforesaid. Barock Ingraham of Deerfield, Wisconsin Sally Cummings wife of Charles Cummings of Clayton. Jane Edner wife of Gardner Edner petitioner aforesaid, of Wilna, Jefferson County New York, children of said deceased and, Curtis Ingraham of Wilna aforesaid Phebe McNitt wife of Fredrick McNitt Mary Lewis wife of George Lewis Elizabeth Knowles wife of Samuel Knowles George Ingraham of Champion Jefferson County New York of full age. Simeon Ingraham & Wheaton Ingraham minors having no general guardian of Champion aforesaid: children of Simeon Ingraham deceased who was a son of said testator. Jane Rice wife of George Rice of Oneida Lake, Onondaga County, New York. Mary Schuyler wife of Orville Schuyler of Wilna aforesaid. Elizabeth Killmer wife of Charles Killmer of Wilna aforesaid of full age. Charles Edner a minor having no general guardian of Wilna aforesaid. Chet Mix of Susan son of deceased daughter of said testator. Said Surrogate therefore appointed Samuel D. Bay, Watertown, Jefferson County, New York. The Special Guardian for said minors to appear for them and take care of their interests in the matter of proving said Will. He having previously contacted in writing to be made appointed to ?. And said Surrogate did thereupon issue a Citation in due form of law, directed to the Widow heirs at law and next kin of said George S. Ingraham deceased, by their respective names, stating their respective places of residence, requiring them to appear before said Surrogate at his office in the Village of Watertown in said County on the 10th day of March A.D. 1863, to attend the Probate of said Will. And on said return day said petitioner appeared in Court before said Surrogate and filed due proof of service of said citation on said ? and to whom the same was directed except said Jane Rice and George Rice and therefore both opposing this matter as is duly adjourned to April 6th, 1863 at 10 o'clock A.M. And a new citation was opened to said Surrogate directed to said Jane Rice and George Rice. Returnable on said April 6th, 1863. And on said return day, petitioner again appeared In Court before said Surrogate and at appearing that said a new citation had not been served ? our opposing. Said Surrogate adjourned the matter to April 27th, 1863 at 10 o'clock A.M. opened a new citation directed to said Jane Rice and George Rice requesting them to appear before said Surrogate at his office aforesaid on said 27th day of April 1863 at 10 o'clock A.M. and attend the probate of said Will. And afterwards to wit: on the 27th day of April A.D. 1863, satisfactory evidence by affidavit was produced and presented to said Surrogate, of the due service of said Citation in the mode prescribed by law, and on that day, no one appearing to oppose the Probate of such Will and proceedings were thereupon had in said Court afterwards, that the said Surrogate took the proofs of said Will hereinafter set forth, upon this 27th day of April A.D.1863 and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate, and the proof thereof to be sufficient, which said Last Will and Testament and proofs are hereinafter recorded in the book. I George Ingraham of the town of Antwerp in the County of Jefferson and State of New York being of sound mind and Memory and considering the uncertainty of this frail and transitory Life: do there make, ordain, Publish and declare this to be my Last Will and testament. That is to Say first after all my Lawful debts are paid and discharged. I give and Bequeeth, to be paid out of any Personal property, One Hundred Dollars to my Son Barrick Ingraham. 2 I give and Beqeath to my Daughter Jane One Hundred Dollars, to be paid as above. 3 I give and Beqeath to my Daughter Sally One hundred Dollars, to be paid as above. 4 I give and Beqeath to my Son Simeon Ingrahams widow Miriah One Hundred dollars and at her decease to her Lawful heirs of my Son Simeon Ingraham. 5 I give and Beqeath to my Beloved Wife Sally all my household furniture; and all the Rest of my personal property after paying from the same; the Several Legacies already named to be hers forever. 6 I also give and Beqeath to my Beloved Wife Sally all my Real Estate during her natural Life; and at her decease to be divided in equal shares Between my Children, above named and their heirs. Respectfully including Mariah and heirs of Simeon Ingraham. That is Mariah and her children by Simeon Ingraham to have one fourth part and the other above. Receive the other three fourth parts one fourth for each one above named in Legise. (legacy?) I make, Constitute and appoint my Beloved Wife Sally to be Sole Exceutrix of this my Last Will and Testament in writing.
