Jefferson County, New York Will Book Volume A page 43 Proof of Will, State of New York, Jefferson County: Be it Remembered, That on the 20th day of May, in the year of our Lord one thousand eight hundred and thirty-two, personally appeared before me, BENJAMIN WRIGHT, Surrogate of the county of Jefferson aforesaid, Edmund M. Eldridge and Samuel Boyden the subscribing witnesses to the will of JOHN FAY, late of the town of Ellisburgh, in the said county of Jefferson, deceased, who being duly sworn did severally depose and say that they saw the said JOHN FAY, deceased, subscribe the instrument which is hereunto annexed and impressed with the seal of office of the said Surrogate, which said instrument purports to be the last will and testament of the said JOHN FAY, deceased, bearing date the third day of November, in the year of our Lord one thousand eight hundred and thirty, that they heard the said JOHN FAY,at the same time declare the said instrument to be his last will, that they subscribed their names thereto as witnesses at the request of the said deceased. And at the time thereof the said JOHN FAY was of sound mind, of full age to execute a will, and not under any restraint. Witness BENJAMIN WRIGHT, Surrogate of the county of Jefferson in the town of Adams the day and year first above written, and the Seal of the Surrogate office of the said county. THE LAST WILL AND TESTAMENT OF JOHN FAY of Ellisburgh, County of Jefferson, State of New York. I, JOHN FAY, considering the uncertainty of life and being of sound mind and memory (blessed be Almighty God for the same) do make and publish this my last will and testament in manner and order following (that is to say). First I give and bequeath unto my beloved wife, Hannah Fay, all of my household furniture to have and enjoy the same during her natural life and after her decease to be equally divided between my two daughters, Polly Northrup and Sally Eastman. 2. I also give and bequeath unto my beloved wife, Hannah, twelve acres of land to be taken off from the west end of my farm to have and to hold during her natural life and after her decease to be divided between my two children, James Fay and Sally Eastman equally. 3. I further give and devise unto my two daughters, Polly Northrup and Sally Eastman all of the east residue and remainder of my real estate to be equally divided between them to hold to them the said Polly and Sally their heirs and assigns forever. And I hereby appoint Thomas Ellis sole Executor of this my last will and testament hereby revoking all former wills by me made. In Witness Whereof, I have hereunto set my hand and seal this 3 day of November in the year of our Lord Eighteen hundred and Thirty.
