D. 1834 before Benjamin Wright Esquire, Surrogate of the said County, for the purpose of proving & recording the last Will and testament of Charles Lewis, late of the Town of Antwerp in the said County, deceased, in pursuance of Chapter 6th, Title first, Article first, Part 2 of the Revised Statutes of the State of New York, on the application of Polly Lewis, the Executor in the said Will named. The said Polly Lewis appeared in person and the other heirs, although duly cited, according to the Revised Statute in such case, made and serviced, did not appear. Whereupon, Calvin Evans & Henry Whitcomb, two of the witnesses to said Will, were severally sworn before said Surrogate in open court & severally testified as follows viz. Jefferson ss: Calvin Evans & Henry Whitcombe of the Town of Antwerp in said County, being first duly sworn, depose & say that they saw Charles Lewis, deceased, subscribe the instrument now shewn to this deponent & which purports to be the last Will & testament of Charles Lewis, late of the Town of Antwerp in said County, deceased, bearing date the twenty-eighth day of September in the year of our Lord one thousand eight hundred & thirty-four; that they heard the said Charles Lewis declare the same to be his last Will and testament & that they, these deponents, did subscribe their names, at the request of the said Charles Lewis, and, further, that, at the time thereof, the said Charles Lewis was of sound mind & memory, of full age and not under restraint & further they say not. The foregoing proofs & examinations taken before me, the Surrogate aforesaid, at the time & place first mentioned, & the depositions of the respective witnesses were, by them, respectively subscribed after having been carefully read over to them and I, the said Surrogate, being satisfied upon the said proof taken that the said last Will was duly executed; that the said Testator, at the time of executing the same, was in all respects competent to devise real estate & not under restraint, do therefore allow the said Will, proofs & examinations to be recorded. Witness: (Signed) Benjamin Wright, Surrogate The last Will and testament of Charles Lewis of the Town of Antwerp in the County of Jefferson in the State of New York: I, Charles Lewis of Antwerp in the county of Jefferson, considering the uncertainty of this mortal life and being of sound mind and memory (blessed be Almighty God for the same) do make and publish this, my last Will and testament, in manner and form following, that is to say: First, I give and bequeath to my youngest son, Charles Lewis, the farm on which I now reside, it being all my real estate, subject to the provisions hereinafter mentioned. Second, I give and bequeath to my beloved wife, Polly, in lieu of all dower, all my household furniture and also one half of the residue of my personal property after paying my just debts and funeral charges. I also give and bequeath to my said wife the use of my dwelling house, if she request it, during her widowhood; also the use of my farm as hereinafter mentioned. Third, I give and bequeath to my said son, Charles, one half of my personal property after satisfying all claims and charges upon it. I give and bequeath to my said son, Charles, all my farming utensils of every kind and nature soever. Fourth, I hereby will, order and direct that, as long as my said wife shall remain sole and unmarried and no longer she and my said son Charles shall and may (unless they otherwise agree) occupy my said farm together and divide the products equally between them. I also order and direct my son Charles to pay to my son, Henry N. Lewis, one hundred and twenty-five Dollars within four years after my decease, in stock, in such proportion & kind as the said Charles may choose. And, lastly, I do hereby appoint my said wife, Polly Lewis, sole Executrix of this, my last Will and testament, and I do hereby order and direct that my debts and funeral charges be paid out of such of my personal estate as is not hereby particularly given and bequeathed to my said wife and son Charles, hereby revoking all former Wills by me made.
