Courthouse, Watertown, NY Will Book Vol B, page 439-445 JOSEPH WAKEFIELD'S ESTATE STATE OF NEW YORK COUNTY OF JEFFERSON SS At a Surrogate's Court held in and for the County of Jefferson at the office of said Surrogate in the Village of Watertown in said County on the fifteenth day of August one thousand eight hundred and forty two - Present John Clarke Surrogate - In the matter of proving the will of the Real & personal estate of Joseph Wakefield deceased. Be it remembered that on the thirty first day of April one thousand eight hundred and forty two Elisha Wakefield of the town of Watertown County of Jefferson and State of New York came before the said Surrogate and made and filed his petition on oath stating and thereby the said Surrogate was satisfied that Joseph Wakefield late an inhabitant of the town of Watertown aforesaid and owning Real and Personal Estate therein had lately died having made and published his last will and testament disposing of said estate and therein had appointed the said Elisha Wakefield and John G. Dresser of Watertown aforesaid executors of said will That the said Joseph Wakefield deceased left the following named persons his heirs at law and next of kin that is to say: Lucy Wakefield widow of the said Deceased. Elisha Wakefield & Egbert Wakefield of Watertown Jefferson County & State of New York Betsey Waters wife of William Waters of Rodman County & State aforesaid Orin Wakefield & Cyrenus Wakefield of Marion County of Dewitt State of Illinois and Zera Wakefield of Echor Tabre County of Union and State of Arkansas- The said persons constituting all the heirs at law and next of kin of the said Joseph Wakefield deceased- And by said petition it was prayed that said will might be proved and recorded as a will of Real and personal estate and that such proceedings might be had for that purpose as were required by law and thereupon the said Surrogate being satisfied of the truth of the matter stated in said petition did on the day and year aforesaid WILL In the name of God amen - I Joseph Wakefield of Watertown County of Jefferson State of New York being weak in body but of sound and perfect mind and memory and Blessed be Almighty God for the same do make and publish this as my last Will and Testament in the manner and form following: First I give and bequeath unto my beloved wife Lucy all that lot and buildings known by the name of the Widow Howell lot lying on Factory Street in the Village of Watertown also all the household furniture that belonged to said Lucy when I married her also one half of the carpeting made whilst she lived with me also I give and bequeath unto my beloved wife Lucy the use of one third of my personal & Real Estate during her natural life I do also give and bequeath the residue of my personal and real estate equally divided to my six children (that is to say} Betsey Waters, Elisha Orin Zerah Cyrenus Egbert Wakefield and lastly I hereby appoint John G. Dresser and my son Elisha Wakefield sole executors of this my last will and Testament and hereby revoking all former wills by me made. Dresser } to my daughter Betsey go to her & her Children May 6th 18[42] STATE OF NEW YORK COUNTY OF JEFFERSON SS I John Clark Surrogate of the County of Jefferson do certify that in performance of and in conformity to the Statutes in such case made and provided upon proofs and examinations taken before me at a Surrogates Court held in and for said County at the office of said Surrogate in the village of Watertown in said County on the fifteenth day of August one thousand Eight hundred and forty two by the oaths of Job Sawyer John G Dresser and Lyman Stanton subscribing witnesses to the within will of Joseph Wakefield deceased. The said will was in said Court before said Surrogate proved approved established and Confirmed and recorded in the book kept therefor by the said Surrogate with the proofs thereof as a good and valid will of Real & personal Estate - In Witness whereof I have hereunto set my hand and affixed my seal of office at Watertown aforesaid this fifteenth day of August one thousand Eight hundred and forty two is Recorded August 15th 1842 S.S. John Clark Surrogate AFFIDAVITS OF WITNESSES TO WILL STATE OF NEW YORK COUNTY OF JEFFERSON SS Surrogate's Court Before John Clark Surrogate In the matter of proving the will of the real and personal Estate of Joseph Wakefield deceased County of Jefferson SS Job Sawyer of the Town of Watertown in said County being first duly sworn deposeth & saith that on the fourth day of May 1842 at Watertown aforesaid he saw Joseph Wakefield deceased subscribe the instrument now shown to this deponent and which purports to be the last will and testament of Joseph Wakefield late of the town of Watertown in said County deceased bearing date the fourth day of May in the year of our Lord one thousand eight hundred and forty two that on the day of the date aforesaid and at te time of signing the same he heard the said Joseph B Wakefield declare the same to be his last will and Testament and that he this deponent & Lyman Stanton & John G.
