Amen, I Eliza A. Elmore wife of Henry S. Elmore (formerly Eliza A. Hutchins, widow of Charles D. Hutchins, deceased) of the city of Brooklyn County of Kings and the state of New York, being of sound mind and memory, do hereby make, publish and declare this to be my last Will and Testament in manner following that is to say viz First: I hereby direct my executor page 422 hereinafter named to pay all my just debts and funeral expenses as soon after my decease as convenient. Second: I hereby give devise and bequeath all my estate both real and personal( except as hereinafter bequeathed) of which I am seized and possessed of at the time of my decease unto my children by my first husband. viz: John B. Hutchins and Minnie S. Hutchins to have and to hold the same unto them their heirs and assigns forever as tenants in common in equal portions share and share alike. Third: I hereby give and bequeath unto my son John B. Hutchins my small diamond ring, and I also give and bequeath my large diamond ring to my daughter Minnie S. Hutchins. Lastly: I hereby constitute nominate and appoint my brother in law Caleb F. Gates of the city of Chicago State of Illinois and my friend Mrs. Barbara Walton of the city of Brooklyn, state of New York to be the executors of this my last will and Testament andI hereby request and desire that my executors or either of them shall not be required to give bonds or any security whatever. I having full and perfect confidence in their integrity and I hereby revoke all othher or prior will or wills by me at anytime heretofore made in Witness whereof I have hereunto set my hand and seal this twenty eighth day of December in the year of our Lord one thousand eight hundred and seventy eight. Elmore the above testatrix to be her last will and Testament in our presence who at her request and in her presence and in the presence of each other have hereunto subscribed our names as witnesses this 28th day of December 1878. Elmore deceased as a will real and page 423 personal estate examination of witnesses sworn and examined in the above entitled matter___ Count of New York to wit: Thomas J. Northall of Brooklyn N. Y. being duly sworn as a witness in the above entitled matter and examined on behalf of the applicant to prove said will says: I was well acquainted with Eliza A. Elmore now deceased I knew the above named decedent for about one year before her death. The subscription of the name of said decedent to the instrument now shown to me and offered for probate as her last will and testament and bearing date the twenty eight day of December in the year one thousand eight hundred and seventy eight as made by the decedent at the City of Brooklyn New York in the presence of myself Barbara Walton and William T. Welch the other subscribing witnesses at the time of such subscription the said decedent declared the said instrument so subscribed by her to be her last will and testament and I thereupon signed my name as a witness at the end of said instrument at the request of said decedent and in her presence the said decedent at the time of so executing said instrument was upwards of the age of Twenty one years and of sound mind and memory and understanding and not under any restraint or in any respect incompetent to devise real estate I also saw said Barbara Walton and William T. Welch the other attesting witnesses sign their names as witnesses at the end of said will and know that the did so at the request of said decedent and in her presence____ Thos. J. Y. being duly sworn as a witness in the above entitled matter and examined on behalf of the applican't to prove said will says I was well acquainted with Eliza A.
