The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.rootsweb.com/~usgenweb *********************************************************************** Transcribed from SAMPUBCO copy New York County Will Book 24, p. 331 Will of William Everit, Brookland, Kings Co., NY In the name of God Amen I William Everit of Brookland in Kings County on the Island of Nassau in the Province of New York being of sound mind and memory and Considering the uncertainty of this frail and Transitory Life do therefore make and ordain this my last Will and Testament that is to say First after all my Just debts be paid and discharged I give and bequeath unto Phebe my Dearly beloved Wife the sum of twenty Pounds and my horse and Chair that is my best Horse and if I leave no horse and Chair then the sum of fifty Pounds with my Mogogna Tea Table and all the household furniture that she brought to me and one pair of brass Top and Irons to be paid to her three months after my Decease I give and bequeath unto my beloved Brother Richard Everit and unto my Cousin James Everit and to my brother Benjamin Everit and to my Brother John Everit and to my Brother Daniel Everit and to my Cousin William Everit and to my Brother in Law Whitehead Scidmore and to my Brother in Law Daniel Scidmore and to my Brother in Law Samuel Scidmore all the remainder of my Estate to be equally divided among them all Likewise I make and Ordain Phebe my Wife and by Brother Richard Everit and my Brother in Law Whitehead Skidmore to be Executors of this my last Will and Testament hereby utterly disallowing and revoking all former Wills by me made In Witness whereof I have hereunto set my hand and Seal the Sixth day of December in the year of our Lord one thousand seven hundred and Sixty three and in the fourth year of his Majesty's Reign. Signed Sealed Published and Declared by the said William Everit as his last Will and Testament in the Presence of us the Subscribers Isaac Hendrickson, David Van Nostrand, Jacob Dean Queens County S. S. Be it remembered that on the twenty seventh day of January one thousand Seven hundred and Sixty four Personally came and appeared before me Thomas Braine Surrogate of the said County David Van Nostrand and Jacob Dean both of Queens County and Township of Hempstead and being duely sworn on their Oaths Declared that they and Each of them did see William Everit Sign and Seal the annexed Instrument purporting to be the Will of the said William Everit bearing Date the Sixth Day of December one thousand seven hundred and Sixty three and heard him publish and Declare the same as and for his last Will and Testament that at the Time thereof he the said William Everit was of sound disposing mind and memory to the best of the knowledge and belief of them the Deponent and that their names Subscribed to the said Will are of their respective proper hands writing which they subscribed as witnesses to the said Will in the presence of the Testator and that they the Deponents saw Isaac Hendrickson the other Witness to the said Will Sign his name as Witness thereto in the Testators Presence Thomas Braine Surrogate Cadwallader Colden Esquire his majesty's Lieutenant and Commander in Chief of the Province of New York and the Teritories depending thereon in America To all to whom these Presence shall come or may concern Greetings Know Ye that at Queens County on the twenty Seventh day of January last before Thomas Braine Esquire thereunto delegated and appointed the last Will and Testament of William Everitt Deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by me the said Deceased having whilst he lived and at the time of his Death goods Chattels and Credits within this Province by means whereof the proving and Registering the said Will and the granting Administration of all and singular the said goods Chattels and also the Auditing allowing and final discharging the account thereof doth belong unto me and that Administration of the said Deceased and any way concerning his Will is granted unto Phebe Everit Richard Everit and Whitehead Scidmore the Executors in the said Will named being first duely Sworn well and faithfully to Administer the same and to make and Exhibit a true and perfect Inventory of all and singular the said goods Chattels and Credits and also to render a Just and true account thereof when thereunto required In Testimony whereof I have caused the Prerogative Seal of the Province of New York to be hereunto affixed at the City of New York the fourteenth day of February one thousand seven hundred and Sixty four.
