First I give and bequeath unto my eldest son Elias Peck the sum of one hundred and seventy-eight dollars to be paid in four years from my decease without interest. Secondly I give and bequeath to my son, Monroe Peck, the sum of two hundred dollars to be paid in full in six years from my decease without interest. Thirdly, I give and bequeath my two daughters, Amy and Sarah Peck, the sum of one hundred dollars each to be paid to each at the age of nineteen years, payable in bedding and furniture. Fourthly, I give and leave unto my beloved wife, Mary Peck, all that my real estate lands and herewith with all the appurtenances there unto belonging and lying in the town of Harrisburgh, county of Lewis and State of New York all that tract or parcel of land that I now own, occupy and possess as described in certain deed from Richard M. Harrison and Phebe his wife as described and recorded in the clerk's office Lewis County and recorded January 30th, 1837 at 1 o'clock PM in Book "S" of deeds, page 2260 the above named lands and herewith together with all the xxxxx issues and xxxxxxx thereof for and xxxxx the term of her natural life and from and after decease of my said wife I will and bequeath the said tenements lands and xxxxxxxxxx to my son, Francis Peck, to be his and assigns forever to have and hold together with all the goods, chattels and xxxxxxx xxxxxxx belonging which said legacy goes to said wife as aforesaid during her natural life. Thereby declare is intended to be and is so given to her in full satisfaction and xxxxxxx of xxx for her xxxxxx and xxxxxx which she may or can in any wise xxxxx or xxxxxx out of my estate. In witness hereof I have set my name and seal this 24th day of January in the year 1842 Signed and sealed in the presences of Dexter Peck, L.S. As the last will and testament of the within named Dexter Peck John Gould Riley X. Xxxxxx Persis Gould . Proceedings in hearing the last well and testament of Dexter Peck, deceased. At a xxxxxxxx court xxxxx at the office of the Surrogate in the village of Lewisville in and for the county of Lewis on the 26th day of February 1842 before William L. Easton, Surrogate. Whereas Monroe Peck, a legatee in the last will and testament of Dexter Peck, late of the town of Harrisburgh in the county of Lewis deceased as is alleged xxxxx to make application to the said Surrogate to have the said will xxxxx before the said Surrogate and recorded as a will relating to both real and personal estate pursuant to the several statutes of the State of New York and the acts according the same. And whereas at the time and place last aforesaid office and before the said Surrogate the said legatee named in the said last will and testament of the said Dexter peck deceased and made xxxxx xxxxx hereof before said Surrogate. First, that the said Dexter Peck died in the town of Harrisburgh in the county of Lewis aforesaid on the 31st day of January last past (1842) of a natural death. 2nd, that at the time of his death he was an inhabitant of the said county of Lewis. 3rd, that the said deceased left a widow named Mary and the following children here xxxx surviving to xxxx, Monroe Peck, Francis Peck, Amy Peck and Sarah Peck residing in the town of Harrisburgh and county aforesaid, and Elias Peck residing in the town of Clayton in the county of Jefferson and no others and that the said Dexter Peck deceased had no other children who died in his Dexter Peck's life time leaving issue. That all of the above named here are above the age of twenty-one years except Francis Peck, Amy Peck and Sarah Peck, who are minors and have no general guardians. It is therefore ordered that axxxxxx to the widow and next of kin and all other persons interested in the hearing and recording of the said will be issued directory thrice to appear before the said Surrogate and attend the probate of the said will at the Hotel of Jared Hxxxxx in the town of Lewisville on the 26th day of March next at 12 o'clock noon and it is further ordered that John Gould of he town of Harrisburgh in the county of Lewis be appointed special guardian for Francis Peck, Amy Peck and Sarah Peck to take xxxx of their interest in the xxxxxxx. Wm. S. Easton, Surrogate Additional Comments: Dexter Peck was the son of Henry Peck and Ann Richardson of Attleborough, MA. Henry is descended from Jospeh Peck and Rebecca Clark, founders of the Peck family in MA (Ref: A Genealogical History of the Descendants of Joseph Peck). Dexter married Mary (or Polly) Peck, daughter of Azariah Peck from Lyme, CT who had moved to Sharon, NY and eventually settled in St. Lawrence Co., NY. Azariah was the son of David Peck and Abigail Southworth. David is descended from William Peck, founder of the CT Peck family (unrelated to the MA Pecks, as far as we know today) (Ref: A Genealogical Account of the Descendants in the Male Line of William Peck)
