Murdock, referee in the action herein after mentioned, ___ of the first part, and Lysander E. Clemons, of the town of Springwater, Livingston County, New York. Whereas, at a Special term of the Supreme Court of the State of New York held at the Court House in Geneseo, Livingston County on the 21st day of February one thousand eight hundred and seventy six it was among other things ordered, adjudged, and decreed by the said Court, in a certain action then pending in the said Court between Truman Bailey and Mary Jane Bailey, his wife, Plaintiff and Job Bailey and Amanda Bailey, his wife, Laura Bailey, Sarah Perkins, Abner Bailey, Emma Bailey, Mary E. Bailey and Permelia Bailey, defendants. That all and singular the premises mentioned in the complaint in said action and herein after described be sold at public auction, according to the course and practice of said Court, by or under the direction of the said James S. Murdock who was appointed a Referee in said action, and to whom it was referred by the said order and judgment of the said Court, among other things, to make such sale; that the said sale be made in the County where the said premises, or the greater part thereof, are situated; that the said Referee give public notice of the time and place of such sale, according to the rules and practice of said Court, and that any of the partied in said action might become a purchaser or purchasers on such sale; that the said Referee after said sale make report thereof to said Court, and after his report of sale shall have been duly confirmed, then that he execute to the purchaser or purchasers of the said premises or such part or parts thereof as shall be sold, a good and sufficient deed or deeds of conveyance for the same . And, whereas, the said Referee, in pursuance of the order and judgment of the said Court, did on the 8th day of April one thousand eight hundred and seventy six sell at public auction at the office of the Hyland House in the village of Dansville, Livingston County, New York the premises in the said order and judgment mentioned, due notice of the time and place of such sale being first given, agreeably to the said order; at which sale the premises hereinafter described were struck off to the said party of the second part for the sum of Two Thousand and fourteen Dollars, that being the highest sum bidden for the same and the said referee report of said sale having been duly confirmed….. (description of property illegible – bad photocopy). Comments: In 1876 the land belonging to James L. Bailey (deceased) was sold at public aution for $2014.74. He had owned 76 and 49/100 acres in lot no. 66 in the northwest corner of the town of Springport. He died intestate.
