Last Will and Testament of Solomon Hubbard Be it Remembered, That heretofore, to wit, on the 19 day of July in the year of our Lord one Thousand nine hundred and two, Abram Goodwin Executor named in the Last Will and Testament of Solomon Hubbard late of the Town of Geneseo in the County of Livingston, deceased, appeared in open Court, before the Surrogate of the County of Livingston, and made application to have the said Last Will and Testament which relates to both Real and Personal Estate, proved; and on such application the said Surrogate did ascertain by satisfactory evidence who were the heirs at law and next of kin of the said testator, and their , respective residences, And afterwards, to wit: on the 19 day of July A.D. 1902, satisfactory evidence by affidavit was produced and presented to said Surrogate, of the due waiver of service of sid Citation in the mode prescribed by law, and on that day, no one appearing to oppose the Probate of such Will, such proceedings were thereupon had in said Court, afterwards, that the said Surrogate took the proofs of said Will and he thereupon adjudged the said Will ____________to be a valid Will________of Real and Personal Estate, and the proofs thereof to be sufficient, which said Last Will and Testament_________and proofs asr as follows, that is to say: I, Solomon Hubbard of Geneseo N.Y. do hereby make publish & declare this my last will & testament as follows, to wit: I give and bequeath to my wife Anna Mirenda Hubbard all my household goods & personal property (except debts & obligations owing to me) absolutely and this rents issues & profits of all the rest of my proproperty both real & personal I give to her during her natural life the whole not so given to my wife absolutely shall be converted into money and safely be vested by my executors herein after named or by such one or more as shall duly qualify as executors. My said wife shall receive all the net income as it accrues. My said executors or such as duly qualify are authorized to sell & convey any and all of my real estate - and in case it appears to them, or such of them as qualify that anything appears necessary for the comfortable support of my said wife they shall pay to her such portion of the principal as they shall deem necessary & proper. In case my said wife dies before me I give & bequeath to my daughters Augusta M. Blakeslee and Alice W. Cole all my household goods and all my goods & chattels excepting money and securities in equal portions-All the residue of my estate both real & personal after the death of my wife I give to my said daughters above named and all my grandchildren living at my death severally equally per capita. Whereas my wife Anna Mirenda has by her will given me the power to dispose of some or all the property which she shall leave & hereby in execution of said power & give devise & bequeath all said property in equal portions to my said daughters Augusta & Alice and my grandchildren at my death living in equal portions share & share alike per capita. Thereby nominate my sons in law Abram Goodwin, Edward C. Cole & Francis D. Blakeslee the executors of this my last will & testament hereby revoking all former wills by me made and I direct that none of them shall be required to give bail or undertaking to take letters notwithstanding they may be non residents. LIVINGSTON COUNTY SURROGATE'S COURT In the matter of Proving the last Will and Testament of Solomon Hubbard Deceased LIVINGSTON COUNTY,ss. Newton B. Gorham being first duly sworn, in open Court, upon his corporal oath doth depose and say, he is with William H. Harrison a subscribing witness to the Last Will and Testament of Solomon Hubbard, late of the town of Geneseo in the County of Livingston, and State of New York, deceased. And this deponent does further say, that the said Solomon Hubbard, deceases, did in the presence and said William H. Harrison deponent subscribe, his name at the end of the instrument in writing, which is now here shown to deponent, and which purports to be the Last Will and Testament of the said deceased, and which bears date on the 23d day of January one thousand eight hundred and ninety-six. That the said deceased did, at the time of subscribing his name to the said instrument as aforesaid, declare the same to be his Last Will and Testament, and this deponent & said William H. Harrison did thereupon subscribe their own respective names at the end of said instrument, as attesting, witnesses to the execution thereof, each at the request of the said deceased and in his presence and in the presence of each other; that the said deceased, at the time of so subscribing his name to said instrument as aforesaid, and publishing said instrument as aforesaid, was upwards of twenty-one years of age, and a citizen of the United Sates; that he appeared to be and deponents believe he was, of sound mind, memory and understanding, and not under any restraint, and as deponents verily believe, in all respects competent to devise real estate; that each of these deponents saw the other sign his name to said instrument in the presence of said deceased. It appearing upon the proofs duly taken in respect to the LAST WILL AND TESTAMENT of Solomon Hubbard late of the town of Geneseo in the County of Livingston, and State of New York, deceased, that the said Will was duly executed, and that the said Solomon Hubbard at the time he executed the same; was in all respects competent to devise real estate, and not under restraint, the said Last Will and Testament-and the proofs and examinations are hereby recorded, sisgned and certified by me, pursuant to the provisions of the Revised Statutes, this 19 day of July S.D. 1902.
