Hubbard Esquire Surrogate of said County the last will & testament of Nathan Brown deceased (a copy whereof is hereunto annexed) was proved & is now approved of & allowed by us; and the said deceased having whilst living & at the time of his death good Chattel & credits within this state [(is?] means whereof the proving and crediting? The said will & granting administration of it all. [Consider?] the goods Chattels & Credits of the said deceased & also the auditing, accounting of [inal]? discharging the account thereof doth belong unto us. The administration of all [finances]? [in]? goods. Chattels & credits of the said deceased as any were concerning the said will is granted unto Nathan Brown & Oliver Brown [Second]? Executors in the said Will named they were? duly sworn will faithfully to administer the Same & & to make & exhibit a true & perfect inventory of all singular the said goods chattels & credits & also to render a just & true account thereof when thereunto required In testimony whereof we have caused the seal of office of our said Surrogate to be hereunto affixed. Witness Thomas H. Hubbard Esquire Surrogate of the said County at Hamilton aforesaid, the twenty ninth day of September in the year of our Lord one thousand eight hundred & seven and of our Independence the thirty first T.H. Hubbard Pg 28 A Copy of the last will & testament of Nathan Brown late of Brookfield deceased. Recorded September 29, 1807. LS In the name of God amen. I Nathan Brown of the town of Brookfield in the County of Chenango and State of New York Yeoman, being weak in body but of a sound & perfect mind and memory. First I give & bequeath unto my beloved wife Mary Two of my [best]? Best cows & two of my best [bros]? [it]? [win aline]? One of my best horses & saddle & bridle six sheep and six large silver spoons and one half of all my household goods for ever & also one third part of all the profits of my Real Estate during her natural life- also I give to my son Nathan Brown One hundred silver dollar to be paid at my deseas [sic] also I give to my wife’s Dafter [sic] Abigail Jabish Brown’s wife One hundred Dollars in silver money to be paid in six months after my deseas [sic] and also after my deseas the remainder of my Real & Personal Estate to be divided into eight equal parts (viz) at the discretion or judgment of of [sic] any two indifferent or disinterested [men]? and also for my said son Nathan Brown to have two parts deducting out of said two parts one thousand & fifty dollars which I have deeded to him in Lands before and to my dafter [sic] Lois Solomon Hoxies wife, one eighth part deducting six hundred dollars deeded to her in Lands & in stock in house hold furniture three hundred & seventy two dollars & sixty cents to come out of her part, and to my son Oliver Brown Two parts and to my dafter Mercy John Rogers wife one part deducting out four hundred & [Twdue]? Dollars and thirty seven cents that she has had in stock and in household furniture and I give unto her the lot of land with the appurtenances that I bought of John Collins in said Town it [bucy]? a part of Lot number twenty Pg 29 Seven in the in the Eighteen township in said town of Brookfield containing twenty five acres be the same more or less to be estimated at three hundred & fifty dollars out of her said part and my son Ezra Brown to have Two parts each child to come into possession of their part or portion at my deseas or when they become of age & [tuely]? Possess and enjoy the same for themselves their heirs and assigns for ever as their own Estate & I also give my wife Mary Brown the use & profits of my son Ezras Brown part until he becomes of age that is twenty one years old And lastly I hereby appoint my sons Nathan Brown & Oliver Brown to be Executors of this my last will & Testament hereby reworking all my former wills by me made In Witness whereof I have hereunto set my hand & seal the sixth day of February in the Year of our Lord Eighteen hundred & six Nathan Brown LS NB the word (dollars) between the 14th & 15th lines from the Bottom on the other side interlined before signed NB the word forever between 9 & 10 line from the top before [sind]? Palmer Amos Rogers Nathan Burdick Pg 30 Probate of Will – Recorded September 29, 1807 Madison County fs: Be it remembered that on the twenty ninth day of September one thousand eight hundred and seven personally appeared before me Thomas H. Hubbard Esquire Surrogate of said county Thomas R. Palmer One of the Witnesses to the said Will who being sworn on his oath declared that he did see Nathan Brown late of the Town of Brookfield in the County aforesaid sign & seal the Instrument in writing of which the annexed is a copy & heard him de[lisn] it for the purposes therein mentioned that at the time thereof he the said Nathan was of sounds disposing mind & memory to the best of the knowledge and belief of [this]? Deponent, that his name subscribed thereunto is differs? own? Proper hand & name that he did subscribe his own proper hand & name thereunto in the presence of the testator, that he did see Amos Rogers and Nathan Burdick subscribe their hands & names thereto as Witnesses in the presence of the Testator and of each other and also on this same day and year Nathan Brown & Oliver Brown second the Executors in the said will named were duly sworn to the faithful performance & execution thereof by taking the usual oath as Executors- Dated at Hamilton the Twenty ninth day of September One thousand eight hundred and seven L.H.
