Electronic copy of surrogate record volume DX obtained through www.sampubco.com Pg. 154 A copy of Letters Testamentary granted upon the estate of Elias Button late of Brookfield in the County of Madison deceased Recorded Jan 14, 1824 LS The people of the State of New York by the grace Pg 155 of God free and Independent To all whom these presents shall come or may concern send greeting Know ya that at Hamilton in the County of Madison before John G Stower [Stoner?] Esq Surrogate of our Said County the last will & testament of Elias Button late of Brookfield deceased (a copy whereof is hereunto annexed) was proved & is now approved & allowed of by us & the said deceased having whilst he lived and at the time of his death goods chattels or credits within this State by means whereof the proving & registering the said will & the granting Administration of all & singular the said goods chattels and credits & also the auditing allowing final discharging the account thereof doth belong unto us the administration of all & singular the goods chattels and credits of the Said deceased & any way concerning his will is granted unto John Button of Brookfield in Said County (Joshua Wifford the other executor therein named having first made & filed in the office of the Said Surrogate a renunciation of said trust in the said will is annexed?) the first Executor Being duly Sworn well & faithfully to administer the same & to make & exhibit at true & perfect Inventory of all and singular the Said goods chattels & credits & also to render a just & true account thereof when thereunto required In testamentary? Whereof we have caused the Seal of Office of our said Surrogate to be hereunto affixed, Witness John G. Stower Esquire Surrogate of the Said County at Hamilton the fourteenth day of January in the year of our Lord one thousand eight hundred & twenty four & of our Independence the forty eighth Jno G. Stower A copy of the last will & testament of Elias Button late of Brookfield in the County of Madison Recorded Jan 14 [24?], 1824 Brookfield Madison County & State of New York Pg 156 I Elias Button being in a low State of health but of a sound & disposing mind & memory Thanks be to God therefor calling to mind the mortality of my body knowing that it is appointed to all men once to die & after that the Judgement [sic] Do make & ordain this my last will & testament Principally & first of all I give or recommend my Soul into the hands of God who gave it & my body to the Earth to be buried in a desent [sic] Christian burial at the discretion of my Executors. Nothing doubting but that at the general Resurrection I shall receive Such a body as shall please the Almighty to prepare for me And as to Such worldly estate wherewith it hath pleased God to bless me with all I give & dispose of in the same manner & form following Item I give & bequeath (after my just debts &? funeral charges are paid) unto my well beloved Nephew John Button Seignor The full control rents & profits after my decease of all my lands & tenements situated in Said Brookfield during his natural life after his deceas I give & bequeath unto Ross Button the west part of the farm I now live on Bounded as follows beginning at the south on on town line on the west side of the highway from thence running northerly (leaveing the orchard on the east & to the north side of said farm making the Said west part twelve rods wider at the North end than at South to be occupied & enjoyed by the Said Ross Button during his natural life & after his deceas said land is to descend to his son Major & to his lawfull heirs in the line of heirship according to the laws of Great Britton. Item I give & bequeath unto Joseph Button after his fathers deceas the Eastern part or residue of the Said farm I now live on and his heirs according to the laws of Great Britton, but if he the Sd Joseph should die with out issue then in that case the said lands is to descend equally to Stephan Kellog son to Stephen and Thankful Kellog & to Elias Palmer son to Pg. 157 Lawton Palmer and to their heirs in the same line of heirship. Item I give and bequeath unto Elias Button 2nd after his fathers deceas all the lands fown On Lot Number Ninety in township eighteen during his natural life & after his deceas to descend to his Son Elias Lewis Button & his heirs in the line of heirship according to the laws of Great Britton, And as to Such movable estate as I am blest with except my books which I give to the friends. I give & bequeath in the following manner Item I give & bequeath to Amy Brown the one sixth Item I give & bequeath unto Nancy one sixth Item I give & bequeath to Betsey one Sixth Item I give & bequeath Thankfull one sixth Item I give & bequeath unto Jemima one twelveth Item I give & bequeath unto Susanah one twelveth Item I give & bequeath unto Abigail one Sixth (closed on the other by?) also also [sic] ordaining & appointing John Button & Joshua Whitford Executors of this my last will & testament hereby disannuling [sic] revoking & disalowing [sic] all former wills by me made ratifying & confirming this & no other to be my last will & testament In witness whereof I have hereunto set my hand & affixed my seal the twenty third day of March in the year of our Lord one thousand eight hundred & thirteen signed sealed published pronounced & declared by the above named Elias Button to be his last will and testament in the presence of us who have subscribed our names as witnesses in the presence of the testator & in the presence of each other Elias Button LS James Rogers, Isaac Brown, Russell Dye, Probate? of the preceding will recorded June (Jan?) 14 (24?) 1824 Surrogates office Madison County LS Be it remembered that on the Seventh day of January one thousand eight hundred Pg 158 & twenty four formally? offered before me John G Stower Surrogate of the County of Madison Isaac Brown one of the witnesses to the said will who being sworn on his oath declares that he did see Elias Button late of Brookfield in said County deceased sign & seal the instrument in writing of which the annexed is a copy & hear him declare of?
