Recorded May 1, 1830. I Robert Smith of Cazenovia county of Madison state of New York facing considering the uncertainty of this mortal life and being of sound mind and memory do make and publish this last will and testament in manner and form following to wit: First I give and bequeath unto my beloved wife Betheah two cows and six sheep with all my household furniture at her own appraisal together with the use and the (impermant) of the farm that I now live on in the town of Cazenovia during her natural life in lieu of dowry = I give and bequeath to my oldest son James Smith one dollar = I give and bequeath to my second son Jonathan Smith one dollar = I give and bequeath John Smith twenty five dollars = I give and bequeath to the heirs of my son Robert Smith deceased fifty dollars = I give and bequeath to my oldest daughter Mary Wellson one dollar = I give and bequeath to the heir of my late son David Smith five dollars = I give and bequeath to my son Samuel Smith one dollar = I give and bequeath to my son Caleb Smith one dollar. I also relinquish any claim against him of every name and notion. I give and bequeath to my daughter Nancy Grames twenty five dollars. I give and bequeath to my daughter Abigail Gillett twenty five dollars. I give and bequeath to my son George Smith twenty five dollars. I give and bequeath to my daughter Phebe Mason ten dollars provided always that should my estate on settlement amount to more than is herein bequeathed, then after paying my just debts and legacies, the remainder to be divided in the same proportion as is above written among my heirs. And for the purpose of enabling my executors to manage the property to the best advantage I hereby authorize them to sell and convey my real and personal estate of every name and nature not interfering with the above testament. Signed sealed published and declared by the above named testator to be his last will and testament in presence of us who have subscribed our names as witnesses in the presence of the testator this fourth day of August in the year of our Lord eighteen hundred and twenty seven. Be it remembered that on the first day of May one thousand eight hundred and thirty personally appeared before Mr. Otis P. Granger (magistrate?) of the county of Madison aforesaid Talcott Backus one of the subscribing witnesses to the will of Robert Smith late of Cazenovia in said county deceased who by me being duly sworn declared that he did see the said Robert Smith deceased, sign, seal and execute the instrument hereunto annexed & (complianced) with the seal of office of the said (surrogate) which said instrument purports to be the last will and testament of the said Robert Smith deceased bearing date the fourth day of August one thousand eight hundred and twenty seven that he has seen the said Robert Smith publish and declare the (unknown) as & for his last will and testament that at the time thereof he the said Robert Smith deceased was of sound disposing mind & memory to the best knowledge and belief of him the said Talcott Backus & that he together with John Service & Joseph Ayer the other witnesses to the said (will) did successfully describe their names as witnesses in the presence of the testator and each other. John Service another witness to the said will was also sworn and examined by me who testified substantially to the sworn fact. Elisha Severance one of the executors of said will was also sworn by me who testified that he received said will from the said deceased in his life time.
