Coman, one of the devises named in the Last Will and Testament of Stephen Coman late of the town of Eaton in the County of Madison, deceased, appeared in open Court, before the Surrogate of the County of Madison and made application to have the said Last Will and Testament which relates to both Real and Personal Estate, proved and on such application the said Surrogate did ascertain by satisfactory evidence who were the widow heirs at law and next of kin of the said testator and their respective residences, vis: Dorothy Coman of Eaton, NY, the widow; Winsor S. Coman of Lenox, NY; Charles H. Coman of Eaton, NY; Jennette K. Griswald of Eaton, NY and said Edwin R. Coman of Eaton, NY, heirs at law and next of kin of the said deceased, said all of full age, and the said Edwin R. Coman having presented and filed with the said surrogate the consent in writing duly proved of the above named widow heirs and next of kin that the proof of said will might be taken at this time without further notice to them therefore. And order was duly made and entered that the proof of said will and said Surrogate did thereupon issue a Citation in due form of law, directed to the heirs at law and next of kin by their respective names stating their respective places of residence, requiring them to appear before said Surrogate to attend to the Probate of said Will. And the said Edwin R. Coman having appeared in said court in pursuance of said order and Afterwards to wit: satisfactory evidence by affidavit was produced and presented to said Surrogate, of the due service of said Citation in the mode prescribed by law, and on that day no one appearing to oppose the Probate of such Will such proceedings were thereupon had in said Court afterwards, that the said Surrogate took the proofs of said will hereinafter set forth, upon this 18th day of April A. D. 1870, and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate and the proofs thereof to be sufficient, which said Last Will and Testament and proofs, are as follows, that is to say Last Will and Testament of Stephen Coman. I Stephen Coman of Eaton County of Madison, NY do hereby make my last will and testament as follows to wit: 1 st I give devise and bequeath to my wife Dorothy during the term of her natural life and in lieu of her dower via my estate, fifty acres of land to be taken from the north part of the farm ---- which I now reside together with the buildings therein with full power to the said Dorothy to bargain sell and convey by warrantee deed the said fifty acres with the buildings thereon and to invest the proceeds of such sale in safe securities and to receive the interest thereof during the term of her natural life aforesaid. I also give and bequeath to my said wife all of my house hold furniture and the interest during her life of four notes which I hold against my four surviving children, to wit one of four hundred dollars against my son Winsor S. Coman and one of five hundred dollars against each of my children Charles H. Coman, Edwin R. Coman and Jenette R. Griswald and at the death of my said wife I direct said notes to be canceled and delivered to the said makers or their representatives. I request my said wife to pat to Martha Humphrey the sum of fifty dollars. 2nd At the death of my said wife Dorothy I give devise and bequeath the above mentioned fifty acres of land or the avails thereof if sold by my wife to my two sons Charles H. and Edwin R. Coman to be divided between them share and share alike. 3rd All the rest residue and remainder of my real estate I give, devise and bequeath the same to my said son Edwin R. Coman and to his heirs and assigns forever. 4th All the personal estate of which I may die possessed and not above disposed of I give and bequeath the same to my wife Dorothy, whom I hereby appoint sole executrix of this my last will and testament and revoke all others. In testimony whereof I have hereunto set my hand and seal this 20th day of November 1868. Stephen Coman, L. S. Mar. 1, 1801) died Nov. 25, 1884. Both are buried at the Morrisville Rural Cemetery in Morrisville, NY along with their son Elijah P. Coman who died Oct. 3, 1864.]
