Delano surrogate of said county the last will and testament of Harmon Whipple late of Riga in said county deceased (a copy is hereunto annexed) was admitted to probate after a citation issued served returned and filed according to law. And after the return and filing of the said citation with due proof of the service of the same on the fourteenth day of March instant. Phinehas Smith, George Redfield, and Spencer Smith of Riga in the county of Monroe, being duly sworn dispose and say that the paper or instrument now produced and thereon to these disponents in the last will and testament of Harmon Whipple late of Riga aforesaid deceased as these disponents venly believe. That they saw the said Harmon Whipple execute the same, he at the same time declaring it to be his last will and testament that at the time of the execution of the said will the said Harmon Whipple was of sound mind and memory and not under astraint and that these disponents then and there subscribed their names to the said will as witnesses to the execution thereof in the presence of each other and in the presence and at the request of the testator. And Phinehas Smith for himself further states that the paper or instrument now produced and shown to this disponent reporting to be the last will and testament of Harmon Whipple was drawn and prepared by this disponent for the testator that after the execution thereof the said testator delivers the said will to this disponent to retain the same until after the decease of the said testator and after his decease to deliver the same to the executor therein named that this disponent retained the said will two days after the decease of the said testator and then delivered the same to Milton Whipple the executor named therein in pursuance of such directions and that the said will now appears in all aspects as when so drawn prepared and executed without any alteration whatsoever. Therefore I the said surrogate of the county of Monroe upon the proof aforesaid (and after having at other days and times for that purpose appointed heard the testimony of Moses Chamberlain, Ann Jennings, Austin Whipple, Jerusha Whipple, Eliha Rupell, Billings Richmond, Archilaus G. Smith, William W. Reed, Daniel Kelsey, John R. Smith, Oren Sec, Phinehas Smith, George Richfield, Spencer Smith, Harmon Wilcox, William Cany, John Beny, Charles Suce & James Harkness touching the execution of the said will and the competency of the said testator to execute the same) being satisfied of the genuisness and validity of the said will do order that the said will be admitted to probate and that letter testimentary thereon be granted to Milton Whipple the executor therein named after the expiration of thirty days from the time of admitting said will to probate on his taking and subscribing the oath of office prescribed by law. In testimony whereof I the said surrogate have hereunto set my hand and seal of office at Rochester aforesaid the twenty seventh day of March in the year of our Lord one thousand eight hundred and thirty three.
