In the name of God Amen: I, James Weeks of the town of Wheatland County of Monroe & State of New York, aged about fifty nine years and upwards & being of sound mind and memory, do make and publish this my last Will and Testament in manner following, to wit: First I give devise and bequeath to my son William E. Weeks a sufficient amount to make him equal with what any other sons have already received from me, and also seven hundred dollars in addition in compensation for his services since he has become of age. Second I give devise and bequeath to Phebe H. Weeks, my wife, One third of all my property both real and personal after my debts are paid, to be possessed and used by her during the period of her natural life. Third I give devise and bequeath to my three sons Samuel W. Weeks, William E Weeks and James E. Weeks all of the rest and residue of my property real and personal to be divided share and share alike among them. Lastly, I make constitute and appoint William Martin of Wheatland executor of this my last Will and Testament hereby revolking all former wills by me made. In witness where I have hereunder subscribed my name this twenty ninth day of ay in the year of our Lord one thousand eight hundred and sixty six. (Signed) James (his mark) Weeks Wm. ? Be it remembered that on the day of the date hereof the last Will and Testament of James Weeks late of the town of Wheatland in said County deceased (being the foregoing written instrument) waqs duly ---- before W.R. Chase Esq. Surrogate of the said County according to law ---- and for the last Will and Testament of the Real & Personal Estate of said deceased which said last Will and Testament and the proofs and examinations taken thereon are recorded in his Office. In Testimony Whereof The Surrogate of the said County has hereunder set his hand and offered his seal of office this 2nd day of July 1866. (signed) W.R. Chase, Surrogate of Monroe County. Surrogate Court - County of Monroe. In the matter of proving the Will of James Weeks Deceased. County of Monroe: William Garbutt & William Cook of the town of Wheatland in the County of Monroe aforesaid being duly sworn do declare and say that they are the subscribing witnesses to the last Will and Testament of James Weeks late of the town of Wheatland in the County of Monroe aforesaid deceased. And these deponents further say that the said James Weeks the said testator did in the presence of these deponents subscribe his name at the end of the instrument which is now shown and exhibited to these deponents which purports to be the last Will and Testament of the said James Weeks and which bear date on the 29th day of May in the year of our Lord one thousand eight hundred and sixty six. And these deponents further say that the said testator did at the said time of subscribing his name as aforesaid at the end of said Will declare the said instrument so subscribed and was exhibited to be his last Will and Testament and these deponents did thereupon subscribe their names at the end of the said will as attesting witnesses thereon in the presence and at the request of the said testator. And these deponents further say that at the said time when the said testator subscribed his name to the said last Will as aforesaid and at the time of these deponents subscribing their names viz attesting witnesses thereon as aforesaid the said testator was of sound mind and memory of full age to execute a Will and was not under any restraint. And that the said Will now appearing in all respects was when so executed without any alterations whatsoever. (Signed) Wm. He was the son of James and Susanna Weeks (also of Wheatland) farmers.
