First, after all my lawful debts are paid and discharged I wish and desire the Homestead on Orange St, City of Rochester is to be kept for the use and benefit of my Widow, and also my daughter Mary, while said daughter Mary remains unmarried. Should my Widow again marry, then the House to be rented for the benefit of bringing up my daughter Nellie untill she is eighteen years of age. After which said homestead to be sold and the proceeds to be divided equally between my son John H. and daughters Mary and Nellie. If either of or any one of them should die before the distribution, the remaining ones to share in the portion of the one dieing. If Nellie should die before becoming of age, said Homestead to be sold and proceeds divided, as before specified. I wish it to be understood that my Widow is to have the use and benefit of the Homestead as long as she remains a Widow, but in case of marrying she forfeits such use and benefit. In no case is said Homestead to be sol donly as above specified. I further desire & wish, if it is found necessary in order to raise funds, that my House on Jay St., City of Rochester be sold when most advantageous, said moneys arising from the sale, together with all my personal property to be under the control of my Widow for hers and my daughters Mary and Nellie's benefit. Likewise, I make constitute and appoint my brothers Thomas & William Ashton to be executors of this my last Will & Testament. In witness whereof, I have hereunto subscribed my name and affixed my seal this twenty eight day of December in the year of our Lord one thousand eight hundred, and sixty seven.
