Stuart(signature) Surrogate Record of Will In the name of God Amen: I Duncan Campbell of the Town of Riga Monroe County and State of New York, being of sound mind and memory and eighty two years of age - blessed be Almighty God for the same do make and publish this my last will and testament. I give and bequeath to my daughter Christy McPherson and to my daughter Ann McMaster five hundred dollars each. I give and bequeath to my granddaughters Christy Ann and Jennett, daughters of my son John deceased, two hundred dollars each. I give and bequeath to my grandsons Archibald and Peter D. sons of Duncan A. Campbell one hundred dollars each, the above mentioned legacies to be paid within six months after my decease out of my personal property to my executors hereinafter named. I give and bequeath to my daughter Jane Brew all my household furniture beds and bedding and I also give devise and bequeath to my grandsons James, Duncan, and John sons of my daughter Jane Brew all of my estate real from and after the decease of their mother. Said real estate is situate in the Town of Riga County of Monroe and State of New York being part of the Peter D. Campbell farm. And I will that the remainder of my personal property I give and bequeath to my children and their heirs respectively to be divided in equal shares between them and paid within six months after my decease. I do nominate and appoint my friends Walter J. Gristin and Peter J. Campbell of the Town of LeRoy Genesee County to be the executors of this my last will and testament. McPherson being first duly sworn in open court upon their several corporal oaths each for himself doeth depose and say that he is a subscribing witness to the last and testament of Duncan Campbell late of the town of Riga in the County of Monroe and State of New York deceased. And these deponents do further say, that the said Duncan Campbell deceased, did in the presence of each of these deponents, subscribe his name at the end of the instruments in writing which is now here shown to these deponents and which purports to be the last will and testament of the said deceased, and which bears date on the 20th day of November one thousand eight hundred and sixty eight, that the said deceased did, at the time of subscribing his name to the said instrument as aforesaid declare the same to be his last will and testament: and these deponents did thereupon subscribe their own respective names at the end of said instrument, as attesting witnesses to the excution thereof, each at the request of the said deceased, and in his presence and in the presence of each other: That the said deceased at the time of so subscribing his name to said instrument as aforesaid, and publishing said instrument as aforesaid, was upwards of twenty-one years of age, and a citizen of the United States: that he appeared to be, and deponents believe he was of sound mind, memory and understanding, and not under any restraint, and as deponents verify believe, in all respects competent to devise real estate: that each of these deponents saw the other sign his name to the said instrument in the presence of the said deceased.
