I, Daniel Claffy of the City of Rochester in the County of Monroe and State of
New York of the age of fifty four years and upwardst and being of sound mind
and memory do make, publish and declare this my last Will and Testament in
manner following that is to say.

First: I give and devise unto my wife Eliza Delaney Claffy her heirs and
assigns all my real estate of every kind and nature and consisting of the
house and lot lying on the North side of Hand St in said City and being the
same premises and real estate on which I now reside with all the hereditaments
and appurtenances thereto belonging or in any manner appertaining to have and
to hold the same to her the said Eliza Delaney her heirs and assigns forever.

Second: I give and bequeath unto mys aid wife all my personal property, goods
and chattels of what name soever and all my choses in action except the part
thereof which I hereinafter give and bequeath unto my daughter Ellen Claffy.

Third: Whereas my late brother James Claffy did by his last Will and Testament
give and bequeath to me the sum of Two Thousand Dollars and which claim is now
in litigation for the recovery thereof.

Now thereof I give and bequeath unto my said daughter Ellen Claffy the sum of
five hundred Dollars to be paid to her by my Executrix hereinafter named out
of the said sum tso devised to me by my said brother whenever the same shall
be recovered and received and in case the amount so recovered and received
after paying the expenses of said litigation shall exceed the sum of two
thousand dollars, I heeby give and bequeath said excess unto my said wife and
all my children equally.

Lastly: I hereby appoint my said wife Eliza Delaney Claffy sole Executrix of
this my last Will and Testament.

In witness whereof, I have hereunto set my hand and seal this twenty third day
of November in the year of our Lord one thousand eight hundred and sixty four.
