I Thomas Conolly of the City of Rochester County of Monroe and State of New York of the age of seventy three years & being of sound disposing mind memory and understanding do hereby make publish and declare this my last will and testament hereby revoking all former wills and codicils to any will or wills by me heretofore made and published in the manner following to wit. First I desire my funeral expenses to be paid as soon as form after my death as is reasonably proper. Second I hereby give devise and bequeath unto my beloved wife Catharine S. Conolly the house and lot where I now reside situate on the south side of Charlotte Street in said Rochester known as lot number 54 to have and to hold the same for and during the full end and time of her natural life with power to sell and convey the same and take absolutely the proceeds thereof in the event that it shall be necessary for her to do to provide for her support and maintenance but this power shall not be exercised except under the direction of the Supreme Court of the State of New York and if she shall die without having sold the said lands and premises then I hereby give devise and bequeath the said lands and premises unto my beloved son John C. Conolly to have and to hold the same to him and to his heirs forever. But the said John C. Conolly shall take the said lands and premises subject to the payment of the following legacies to be and to become a charge upon the same upon the death of my said beloved wife. to wit: I hereby bequeath to Mary Conolly the wife of my beloved son Andrew Conolly the sum of four hundred dollars to be paid to her without interest by my said son John C. Conolly within two years from and after his mothers decease or sooner at his pleasure. And I also hereby bequeath to my beloved daughter Margaret Conolly the sum of two hundred dollars to be paid to her with interest by my said son John C. Conolly within two years from and after his mother's death. And the above devise to my beloved is also hereby made subject to the right of my beloved son John C. Conolly, and also of my belvoed Margaret Conolly each to have and make their home with my beloved wife upon the said premises so long as their deportment towards their mother and towards each other shall be orderly and becoming. and also so far as respects my said son John C. Conolly for so long also as he shall continue to provide for the family wants of his mother and his sister Margaret as he has heretofore done and is now doing. Third. I also bequeath all my personal property to my beloved Wife to dispose of as she sees proper. Lastly. I hereby nominate and appoint my friend George W. Parsons Esq. of Rochester aforesaid sole executor of this my last Will and Testament.
