And I do hereby request and appoint Edward Lanetel to be my Executor of this my last Will and Testament hereby revoking all former will by me made. In witness whereof I have hereunto set my hand and seal the twentieth day of July in the year of our Lord one thousand eight hundred and fifty nine. J. Hine L.S. Surrogate of the said County according to law, as and for the last Will and Testament of the Real and Personal Estate of said deceased: which said last Will and Testament and the proofs and examinations taken thereon are recorded in his office. County of Monroe - to wit: Ira M. Randall of Riga being duly sworn as a witness in the above entitled matter, and examined on behalf of the applicant to prove said Will says that he was well acquainted with O. Fuller late of the town of Riga in said County and with his manner and style of handwriting having often seem him write and that he verily believes and has no doubt, but that the signature O. Fuller subscribed as a witness to the instrument in writing now produced and shown to deponent, purporting to be the last Will and Testament of said John Hine, deceased bearing date the Twentieth day of July in the year one thousand eight hundred and fifty nine is the proper signature and handwriting of said O. Fuller who is now deceased. Sworn this 9th day Ira M. Randall Of May 1871 before me} W. D. Stuart, Surrogate Surrogates Court - Monroe County In the Matter of Proving the last Will and Testament of John Hine Deceased } Monroe County SS Edward Lanetel being first duly sworn doth depose and say that he is a subscribing witness to the last Will and Testament of John Hine last of the town of Riga in the County of Monroe and State of New York, deceased. And this deponent further says that the said John Hine, deceased, did in the presence of this deponent and the other subscribing witness subscribe his name at the end of the instrument in writing which is now here shown to this deponent and which purports to be the last Will and Testament of said deceased and which bears date on the 20th day of July one thousand eight hundred and fifty nine Said decd. Died at Riga on the 18th of July 1860: that the said deceased did at the time of subscribing his name to the said instrument as aforesaid declare the same to be his last Will and Testament and these deponents did thereupon subscribe their own respective names at the end of said instrument as attesting witnesses to the execution thereof each at the request of the said deceased and in his presence and in the presence of each other: That the said deceased, at the time of so subscribing his name to the said instrument as aforesaid and publishing said instrument as aforesaid was upwards of twenty one years of age and a citizen of the United States: that he appeared to be and deponents believe he was of sound mind memory and understanding and not under any restraint and as deponent verily believes on all respects competent to devise real estate: that this deponent saw the other witness sign his name to the said instrument in the presence of the said deceased.
