I, Catherine Middleton (Widow) of the City of Rochester, County of Monroe and State of New York, being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefor make, ordain, publish and declare this to be my last Will and Testament, that is to say: First: After all my lawful debts are paid and discharged, I give and bequeath To Elizabeth Middleton (widow of my Son, George Middleton deceased) $200.00 To my Grandson, William A. Middleton $100.00 To my Grandson, John M. Middleton $100.00 To my Son, John Middleton, Minister of the Gospel $400.00 To my Son, Joseph Middleton (Farmer) $300.00 To my Son James Middleton (Farmer) $300.00 To my Daughter, Jane E. Campbell $300.00 also To my Daughter, Jane E. Campbell, I give and bequeath a note for $600.00 dated April 21, 1863 and payable on demand. To my Granddaughter, Margaret J. Gormly $ 60.00 To my Grandson, William M. Gormly $ 60.00 To my Grandson, Thomas A. Gormly $ 60.00 To my Daughter, Jane E. Campbell all the residue of my property. Likewise I make constitute and appoint my son-in-law, James Campbell of the City of Rochester (Mechanic) and my son, Joseph Middleton, town of Ontario, Wayne Co. (farmer) to be Executors of this my last Will and Testament, hereby revoking all former Wills by me made. In witness whereof I have hereunto subscribed my name and affixed my seal the twelfth day of March in the year of our Lord, one thousand eight hundred and sixty eight. S/Catherine Middleton (U.S. Int. Rev. $1.00 stamp cancelled) The above written instrument was subscribed by the said Catherine Middleton in our presence, and acknowledged by her to each of us and she at the same time declared the above instrument so subscribed to be her last Will and Testament: and we at her request, have signed our names as witnesses hereto, and written opposite our names our respective places of residence. David Scott, Minister of the Gospel, Rochester. Samuel R.. Campbell, 12 Franklin Square, Rochester State of New York Monroe County, ss. Be it remembered that on the date of the date hereof, the last Will and Testament of Catharine Middleton, late of the City of Richester in said County deceased. (Being the foregoing written instrument) was duly proved before W. D. Shuart (?), Esq. Surrogate of the said County according to law as and for the last Will and Testament of the Personal estate of said deceased which said last Will and Testament, and the proofs and examinations taken tereon, are recorded in his office. In testimony Whereof, the Surrogate of the siad County has hereunto set his hand and affixed his seal of office this 28th day of November 1871. L.S. W. D. Shuart, Surrogate Surrogate's Court - County of Monroe In the matter of proving the last Will and Testament of Catharine Middleton - deceased. As a will of Personal Estate - Examinations of witnesses sworn and examined in the above entitled matter: County of Monroe, to wit: James Campbell of Rochester being duly sworn as a witness in the above entitled matter, and examined on behalf of the applicant to prove said will, says that he was well acquainted with Catharine Middleton late of the City of Rochester in said county, and with her manner and style of hand writing having often seen her write, and that he verily believes and has no doubt, but that the signature Catharine Middleton subscribed as Testator to the instrument in writing and produced and shown to deponent, purporting to be the last Will and Testament of said Catharine Middleton deceased bearing date the 12th day of March in the year one thousand eight hundred and sixty eight is the proper signature and handwriting of said Catharine Middleton. That deponent also says that he is acquainted with the handwriting of David Scott and Samuel R. Campbell the witnesses to the said Will and that these signatures subscribed to the said instrument are the genuine signatures of each of said witnesses. That said David Scott is now deceased and the said Samuel R. Campbell is not a resident of this State and is absent from the State of New York. s/ James Campbell Subscribed and sworn this 29th day of November 1871. s/ W. D.
