I also give and bequeath to my Daughter Nancy Bassett the sum of twenty five dollars - which said legacies or sums of money I will and order shall be paid to the said respective legatees within three years after my decease and lastly as to all the residue of my personal estate, goods and chattels of what kind and nature sworn, I give and bequeath the same to my said beloved Wife Susanna Weeks whom I hereby appoint with George Woode and John Shadbolt of the Town of Wheatland aforesaid to execute this my last will and testament, hereby revoking all former wills by me made. In witness whereof have hereunto set my hand and seal the eighth day of March in the year of our Lord one thousand eight hundred and thirty four. Be it remembered at a Surrogates Court holden at Rochester in and for the County of Monroe on the twenty fourth day of June in the year of our Lord one thousand eight hundred and thirty nine before Mortimer F. Delano, Surrogate of the said County the last will and testament of James Weeks of the town of Wheatland in the County of Monroe aforesaid deceased of which the preceding Record of Will is a true copy was admitted to be proved and Recorded as a will of Real Estate after citation to the heirs and next of kin of the said deceased had been issued served returned and filed according to Law requiring them to appear before the said Surrogate to attend the proof of the said Will and after the returning and filing the said Citation with due proof of the service thereof in due form of Law - the said will was produced in the said Surrogate Court before the said Surrogate and the following definitions of the Witnesses were taken to establish the genuineness and validity of the said Will for the purpose of having the same proved and Recorded as a Will of Real Estate. County of Monroe Surrogates Court In the matter of proving the will of James Weeks deceased. County of Monroe. John Shadbolt, George Wood and Isaac J. Lewis of the town of Wheatland in the County of Monroe, aforesaid being duly sworn doth depose and say that they are subscribing witnesses to the last will and testament of James Weeks late of the town of Wheatland in the County of Monroe, aforesaid deceased, And these deponents further say that the said James Weeks the said testator did in the presence of these deponents subscribe his name at the end of the instrument which is now shown and exhibited to these deponents and which purports to be the last will and testament of the said James Weeks and which bears date on eighth day of March in the year of our Lord one thousand eight hundred and thirty four, And these deponents further say that the said testator did at the same time of subscribing his name as aforesaid at the end of the said Will declare the said instrument so subscribed and now exhibited, to be his last will and testament, and these deponents did thereupon subscribe their names at the end of the said will as attesting witnesses thereto in the presence and at the request of the said testator, And these deponents further say that at the said time when the said testator subscribed his name to the said last will as aforesaid and at the time of these deponents subscribing their names as attesting witnesses thereto, as aforesaid the said testator was of sound mind and memory, of full age to execute a will and was not under any restraint, And that the said will now appears in all respects as when so executed, without any alteration whatsoever. Delano Surrogate of Monroe County County of Monroe Surrogate Court In the matter of proving the will of James Weeks deceased County of Monroe. Isaac J. Lewis of the town of Wheatland in the County of Monroe, aforesaid being duly sworn, doth depose and say that, he drew the last will and testament of James Weeks deceased, and that on or about the Eighth day of March in the year of our Lord one thousand Eight hundred and thirty four the said last Will and Testament was delivered to his deponent for safe keeping by the said James Weeks the testator and that the instrument now produced and offered for probate is the same instrument which was so delivered as aforesaid to his deponent; and further this deponent saith that the said instrument was safely and securely kept by this deponent in his possession from that time until on or about the twentieth day of March in the year of our Lord one thousand eight hundred and thirty nine when the said instrument was delivered by this deponent to George Woode one of the executors named in the said will. George Wood of the town of Wheatland in the County of Monroe, aforesaid being duly sworn doth depose and say that he is the Executor named in the last Will & Testament of James Weeks deceased and that on or about the twentieth day of March in the year of our Lord one thousand eight hundred and thirty nine the said last Will and testament was delivered to this deponent for safe keeping by Isaac Lewis and that the instrument now produced and offered for probate is the same instrument which was so delivered as aforesaid to this deponent, and further this deponent saith that the said instrument was safely and securely kept by this deponent in his possession from that time until on or about the twenty second day of March in the year of Our Lord one thousand eight hundred and thirty nine when the said instrument was delivered by this deponent to the Surrogate of the County of Monroe.
