I, George Keeney of the city of Rochester, Monroe County in the State of New York, Physician, do make and publish this my last will and testament hereby revoking and making void all former will by me at any time heretofore made. First. I direct that my debts and funeral expenses be paid as soon as possible after my decease, out of the first moneys that shall come into the hands of my Executor. Second. I give and bequeath to my beloved children James Minton Keeney and Hellen Melinda Keeney all my personal estate and I direct that said Estate principal and Interest, or so much thereof as may be necessary shall be used for the support and education of the said James Minton and Hellen Melinda according to their several necessities. Third. In the event of the death of either of said children before my own decease, the child surviving shall have all of said estate to be used for his education and support as aforesaid. Fourth. It is my will that said estate shall be considered a joint fund to be used as aforesaid until the eldest of said children shall arrive to the age of twenty-one years when the surplus if any shall be equally divided share and share alike between said children and the share of said eldest child shall be paid to him and the other share to the said Hellen upon her arriving to the age of twenty one years. Fifth. If neither of said children should survive me the said estate shall go to my beloved Sister Mrs. Wealthy_ Luce: but in the event that neither of the said children nor my said sister be living at the time of my decease then the said estate shall be divided equally between my two beloved brothers, John and Franklin, share and share alike. And I do hereby make and ordain my esteemed neighbor and friend Levi A. Ward Esq. Of the said city of Rochester Executor of this my last will and testament. In witness whereof, I George Keeney the testator have to this my will on the foregoing page written set my hand and seal this twentieth day of March in the year of our Lord one thousand eight-hundred and forty six. Mullen State of New York Monroe County Be it remembered that at a Surrogate Court held at Rochester in and for the County of Monroe on the twenty eight day of May 1846 before Simeon B. Jewett, surrogate of the said County the last will and testament of George Keeney, late of the city of Rochester in the County aforesaid deceased or which the preceding Record of Will is a true copy was duly proved and admitted to probate at as a will of personal estate after citation for that purpose had been issued served returned and filed according to the law and the following depositions of the witnesses were thereupon taken and filed to establish the execution, custody, genuineness and validity of the said Will County of Monroe Surrogate Court Int he matter of proving the will of George Keeney deceased Elijah J. Keeney of the city of Rochester in the county of Monroe aforesaid, being duly sworn says that the Instrument now produced to this deponent is the last will and testament of George Keeney late of the City of Rochester in the county of Monroe aforesaid deceased: that the said deceased died in the city of Natchez in the state of Mississippi and executed the said Will at the place last aforesaid that Nathan L. Carpenter, Joseph Farnham, William F. Mellen (sic) the subscribing witnesses to the said Will reside in the city of Natches (sic) aforesaid and that this deponent is well acquainted with the handwriting of the of the said George Keeney the said testator of the and of the said Nathan L. Carpenter, Joseph Farnham and William F. Mellen the subscribing witnesses to said will and that the signatures of each of said persons to said Will is genuine and in their own proper handwriting respectively which said Will bears date the twentieth day of March in the year 1846. And this deponent further says that at the said time when the said testator subscribed his name to the said last will as aforsaid and at the time the said Nathan L. Carpenter Joseph Farnham and William F. Mellen subscribing their names and attesting the witnesses thereto as aforesaid the said testator was of sound mind and memory and of full age to execute a will and was not under any restraint as this deponent verily believes and this deponent saith not. E. J. Keeney Simeon P. Jewett, Surrogate County of Monroe Surrogate Court in the matter of proving the will of George Keeney, deceased. Levi A. Ward of the city of Rochester in the county of Monroe, aforesaid, being duly sworn doth depose and say that on or about the _ day of April in the year of our Lord one thousand eight hundred and forty six the said last will and testament came to the deponent by mail from the city of Natches and the State of Mississippi in an envelope enclosed by the testator and that the instrument now produced and offered for probate is the same instrument which was so received as aforesaid by this deponent and further this deponent saith that the said instrument was safely and securely kept by this deponent in his possession from that time until on or about the 16th day of May in the year of our Lord one thousand eight hundred and forty six when the said instrument was delivered to the Surrogate of Monroe County for proof. That previous to the departure or the said testator from the city to go south this deponent was requested the said testator to act as his executor in case of his death. L. A.
