All rights reserved. http://www.usgwarchives.org/copyright.htm http://www.usgwarchives.org/ny/nyfiles.htm Submitted Date: March 4, 2004 This file has been created by a form at http://www.poppet.org/nyfiles/ File size: 3.6 Kb ************************************************ Source: SAMPUBCO photocopy Monroe Co., NY Will Book 3 page 307 Written: August 12 1844 Recorded: September 9 1844 The last Will and Tesatment of Josiah Rich of Ogden in the county of Monroe and State of New York: I Josiah Rich, considering the uncertainty of human life do make & publish this my last will and testament in manner and form following that is to say: First I devise and bequeath to my wife Polly for the term of her life & in lieu of dower and her distributive share of my estate three young cows, my buggy waggon a horse and single harness my dwelling house wherein I reside, and all the furniture in the same and the provisions on hand at the time of my death which shall have been provided for family use and the land adjoining said house as described as follows: Beginning on the West line of the garden or fruit yard West of the house and at the south west corner of said garden running thence northerly following the fence to the north line of the original lot containing about one hundred and ten acres on which said garden is situated, thence Easterly along the north line of said lot so far as it is from the place of beginning aforesaid to the south east corner of the garden East of the house, thence northerly to said south east corner of said last mentioned garden and then (word blurred) along the highway to the place of Beginning and all the buildings & outhouses on said described pieces of land with the appurtenances to have hold and enjoy for and during the period of her natural life: Second I give and bequeath to my five eldest children viz: Jane Maria wife of James Brookins, Abiel F. wife of William P. Nottingham, Leonard Rich, William Rich & Judith R. wife of Freeman Thompson to each of them so much as shall together with what I have already advanced to him or her in cash by way of advancement make the sum of five hundred dollars, and in case either of them dies before me then his or her share of this bequest to go to his or her heirs: Third I give, devise and bequeath all the rest and residue of my property both real and personal to all my children to be equally divided between them and in case either of them shall die before me then his or her share to go to his or her heirs, all my just debts and expenses to be paid thereout however before any of said property is divided: Fourth I will and direct that my minor children shall remain with and be respectively brought up & controlled by my widow till they severally become of age: Fifth I hereby nominate constitute & appoint my sons in law James Brookins & William P. Nottingham Executors of this my last Will and testament. In witness whereof I have hereto set my hand & seal this twelfth day of August one thousand eight hundred and forty four. Josiah Rich L.S. The above instrument consisting of one sheet was now here subscribed by Josiah Rich the testator, in the presence of each of us and was at the same time declared by him to be his last will and testament and we at his request sign our names hereto as attesting witnesses.
