Smith of the town of Clarkson County of Monroe State of New York being of sound mind and memory, do make ordain publish and declare this my Last Will and Testament, that is to say: First After all my lawful debts are paid and discharged, I give, devise and bequeath the use of all my property that I may be possessed of at the time of my decease both Real and Personal to my beloved wife Margaret during the term of her natural life. Second - I give and bequeath to my daughter Hannah one thousand dollars to Be paid within one year after my wife's decease. Third I give and bequeath to my son John B. Smith Eight Hundred dollars To be paid within one year after my wife's decease. Fourth I give and bequeath to my grand sons Andrew V. Smith and Emerson Smith sons of my son Garrett Smith Eight Hundred dollars to be equally divided between them. Fifth I give and bequeath the remainder of my estate if any there be after Paying the above legacies equally between my children viz Hannah John, Ellen and the heirs of my son Garrett That is the heirs of my son Garrett are not to Have exceeding the one fourth part of it or one eighth each. My daughter Ellen has heretofore had One thousand dollars which I consider To be all of her share, except there may a remainder as above named which she Is to share with the rest. Likewise I make, constitute and appoint my daughter Hannah to be executor Of this my last Will and Testament, hereby revoking all former Wills by me made. In witness Whereof, I have hereunto subscribed my name and affixed my seal, the 21st. day of November in the year of our Lord one thousand Eight hundred and seventy eight. his Aaron X G. Smith Mark The above instrument, consisting of one sheet, was at the date thereof subscribed by Aaron G. Smith in the presence of us and each of us: he at the time of making Said subscription, acknowledged that he executed the same and declared the said instrument so subscribed by him to be his last Will and Testament. Whereupon we then and there, at his request, and in his presence and the presence Of each other, subscribed our names as witnesses thereto. Russell C. Bates residing at Parma Centre N.Y. By this Codicil to my last will and testament made November 21st, 1878 I hereby revoke the legacy given to my daughter Ellen giving her an equal share with my other children in the remainder named in said Will, as I think she has had her share and she is not-to have any more of my estate and I give and bequeath the share she was to have of the remainder named in said will to my son John and to my grandsons Andrew V. Smith and Emerson Smith that is my son John is to have one half of the same and the other half to be divided equally between my Grandsons above named Second I give and bequeath to my daughter Hannah my horse, harness, and carriage that I am possessed of at the time of my decease, to have immediately after my decease, in consideration of services performed for me during my life.
