I Martha Jordan, of the Village of Honeoye Falls in the County of Monroe and State of New York, being of sound mind and memory, and considering the uncertainty of this grail and transitory life, do therefore make, ordain, publish and declare this to be my last Will and Testament that is to say. First. After all my lawful debts are paid and discharged, I give and bequeath to my husband Henry Jordan, all that tract or parcel of land, situate in the Village of Honeoye Falls in the town of Mendon County of Monroe and State of New York. Bounded and described as follows on the easterly by the highway leading from said village to Lima, northerly by lands now owned and occupied by William B. Baker, westerly and southerly by lands now owned and occupied by Elias L. Yorks and William R. Yorks. It being the same premises conveyed to me by Mary A. Tefft, and Leon D. Tefft her husband by deed bearing date the twenty sixth day of March in the year of our Lord one thousand eight and seventy three, and recorded in the Clerks Office of the County of Monroe on the 22nd day of April 1873 at 10 o'clock A.M. to which reference is hereby had for a further description of the said premises. And lastly I give and bequeath to my said husband, Henry Jordan, all my personal property of every name and kind whatsoever to have and to hold the same, together with the premises herein described, his heirs and assigns forever. Likewise, I make constitute and appoint my said husband Henry Jordan, to be executor of this my last will and testament, hereby revoking all former Wills by me made. In Witness thereof I have hereunto set my seal and subscribed my name thereto, the 23rd day of December in the year of our Lord one thousand eight hundred and eighty. Martha Jordan {L.S.} The above written instrument was subscribed by the said Martha Jordan, in our presence, and acknowledged by her to each of us, and she did at the same time declare the above instrument so subscribed to be her last Will and Testament, and we at her request have signed our names as witnesses hereto in her presence and in the presence of each other and written opposite our names our respective place of residence. William G. Starr, Honeoye Falls NY William Burberry, Honeoye Falls NY SURROGATE'S COURT In the Matter of Proving the Last Will and Testament of Martha Jordan, Deceased. Monroe County, ss. William G. Starr and William Burberry being first duly sworn in open Court, each for himself doth depose and say, that he is a subscribing witness to the last Will and Testament of Martha Jordan late of the Village of Honeoye Falls, in the County of Monroe and State of New York, deceased, And these deponents do further say, that the said Martha Jordan deceased, did, in the presence of each of these deponents, subscribe her name at the end of the instrument in writing, which is now here shown to these deponents, and which purports to be the last Will and Testament of the said deceased, and which bears date on the 23rd day of December one thousand eight hundred and eighty. That the said deceased died on or about the 23rd day of May, 1881, at Honeoye Falls aforesaid as deponents are informed and believe. That the said deceased did, at the time of subscribing her name to the said instrument as aforesaid, declare the same to be her last Will and Testament; and these deponents did thereupon subscribe their own respective names, at the end of said instrument, as attesting witnesses to the execution thereof, each at the request of the said deceased, and in her presence, and the presence of each other. That the said deceased, at the time of so subscribing her name to said instrument as aforesaid, and publishing said instrument as aforesaid, was of full age; that she appeared to be, and deponents believe she was of sound mind, memory and understanding, and not under any restraint, and as deponents verily believe, in all respects competent to devise real estate; that each of these deponents saw the other sign his name to the said instrument, in the presence of said deceased. It appearing upon the proofs duly taken in respect to the Last Will and Testament of Martha Jordan late of the Village of Honeoye Falls in the County of Monroe and State of New York, deceased, that the said Will was duly executed, and that the said Martha Jordan at the time she executed the same, was in all respects competent to devise real estate, and not under restraint, the said last Will and Testament and the proofs and examinations are hereby recorded, signed and certified by me, pursuant to the provisions of the Revised Statutes this 3rd day of March, A.D. 1884.
