SUTTON In the Name of God, Amen I Wm M. Sutton of the town of Webster, in the County of Monroe and State of NY being of sound mind and memory, do make and publish this my last will and testament. 1st I give and bequeath to my wife Amanda the whole and sale use of my real & personal property, interest and principal for her sole benefit during her life. 2nd I give and bequeath to each of my children Wm W., Chas. W., Nelson and Cordelia or their legal heirs, an equal proportion of both real and personal of whatever is left of my estate at the decease of my wife Amanda. 3rd In witness whereof I have hereunto set my hand and seal this 22nd day of Aug. 1876. W. M. Sutton Signed, sealed, declared and published by the said Wm. M. Sutton, as and for his last will and testament in presence of us, who at his request and in his presence, and in presence of each other, have subscribed our names as witnesses hereto. H. C. Stoddard who resides in Webster, Co. of Monroe A. J. Pratt who resides in Webster, Co. of Monroe It appearing upon the proofs duly taken in respect to the Last Will and Testament of William M. Sutton late of the town of Webster in the County of Monroe and State of New York, deceased, that the said will was duly executed, and that the said William M. Sutton at the time be executed the same, was in all respects competent to devise real estate, and not under restraint, the said last Will and Testament and the proofs and examinations are hereby recorded, signed and certified by me pursuant to the provisions of the Revised Statutes this 3rd day of March 1884 A.D. Recorded and Examined March 3rd 1884 by E Mc P.Awen Clerk Surrogates Court. SURROGATES COURT, MONROE COUNTY, SS. Henry C. Stoddard and Almon J. Pratt being first duly sworn in open Court, each for himself doth depose and say that he is subscribing witness to the last Will and Testament of William M. Sutton late of the town of Webster in the county of Monroe and State of New York, deceased, And these deponents do further say, that the said William M. Sutton deceased did in the presence of each of these deponents subscribe his name at the end of the instrument in writing, which is now here shown to these deponents, and which purports to be the last Will and Testament of the said deceased, and which bears date on the 22nd day of August one thousand eight hundred and seventy six. that the said deceased died on or about the 26th day of December 1878, at Webster aforsaid as deponents are informed and believe. That the said deceased did, at the time of subscribing his name to the said instrument as aforesaid, declare the same to be his last Will and Testament; and these deponents did thereupon subscribe their own respective names, at the end of said instrument, as attesting wittnesses to the execution thereof. each at the request of the said deceased, and in his presence, and the presence of each other. that the said deceased, at the time of so subscribing his name to said instrument as aforesaid and publishing said instrument as aforesaid was of full age; that he appeared to be, and deponents believe he was of sound mind, memory and understanding, and not under any restraint, and as deponents verily believe, in all respects competent to devise real estate; that each of these deponents saw the other sign his name to said instrument, in the presence of said deceased.
