Amen I, Morrison Jeffords of the Town of Henrietta, County of Monroe and State of New York, aged seventy-nine (79) years and Being of Sound mind and memory do make, Publish and Declare this, my Last Will and Testament in manner and form as follows Frist I give and Bequeath to my Daughter Nancy M. Wife of Henry Clickner, of the State of Michigan one hundred Dollars to Be Paid to her by my Executor one year after my decease in case she should be Living at that time and in case of her death, then I direct that the said sum of one hundred (100) dollars be equeally divided among her children share and share alike Secondly I give and Bequeath to my Grand Daughter Effa Iona Smith, Daughter of John A., and Sarrah Smith my Bed and Bedding. Thirdly I hereby give and Bequeath to my Sons and Daughters, herein named Morris W. Jeffords of the Town of Henrietta County of Monroe, State of New York, Eber L. Jeffords, Joseph B. Jeffords, Horace J. Jeffords and to my Daughters Emily, Wife of Robert B. Lyday of Kansas, Sarah J., wife of John A. Smith, Ellen wife of Winfried S. Mack, all the Rest Residue and Remainder of my Property Both Real and Personal Be Equeally divided Between them Share and Share alike - after the payment of all my Just Debts and the erection of a suitable monument at my grave. Fourthly I hereby nominate, constitute and appoint my Brother Thomas J. Jeffords of the Town of Rush County of Monroe, State of New York, Sole and Only Executor of this my Last Will and Testament with full power and authority to Sell and convey my Real Estate, and from the Procedes of such Sale to Pay the Several Legacies hereinbefore mentioned and to Do and Perform every necessary act and deed for the final settlement of my Estate hereby Revoking all former Wills by me made. Jeffords, } Rush Monroe C., N. Y. George C. Terry } Henrietta, Mo. N. Y. SURROGATES COURT In the matter of Proving the Last Will and Testament of Morrison Jeffords Deceased Monroe County, ss. Thomas J. Jeffords, and George C. Terry being first duly sworn in open Court, each for himself doth depose and say, that he is a subscribing witness to the last Will and Testament of Morrison Jeffords, late of the Town of Henrietta, in the County of Monroe and State of New York, deceased. And these deponents do further say, that the said Morrison Jeffords deceased, did, in the presence of each of these deponents, subscribe his name at the end of the instrument in writing, which is now here shown to these deponents, and which purports to be the last Will and Testament of the said deceased, and which bears the date on the 17th day of July one thousand eight hundred and eighty five. That the said deceased died on or about the 25th day of August 1886, at Henrietta, N. Y. aforesaid, as deponents are informed and believe. That the said deceased did at the time of subscribing his name to the said instrument as aforesaid, declare the same to be his last Will and Testament; and these deponents did thereupon subscribe their own respective names, at the end of said instrument, as attesting witnesses to the execution thereof, each at the request of the said deceased, and in his presence, and the presence of each other. That the said deceased, at the time of so subscribing his name to said instrument as aforesaid, and publishing said instrument as aforesaid, was of full age, and a citizen of the United States; that he appeared to be, and the deponents believe he was, of sound mind, memory and understanding, and not under any restraint, and as deponents verily believe, in all respects competent to devise real estate; that each of these deponents saw the other sign his name to the said instrument, in the presence of said deceased.
