Second - In recognition, consideration, and appreciation of the material assistance heretofore rendered to me by my said son Joseph Weiland, I further give and bequeath to him the sum of Five Hundred Dollars ($500.~). Third - I give to whatever priest shall be Rector of St. Jospeh's Roman Catholic Church of Rochester, NY at the time of my death the sum of Fifty Dollars on the condition that he shall say or cause to be said masses for the repose of my soul. Fourth - I give decree and bequeath unto my beloved children, Henry Joseph Weiland, William Joseph Weiland, and Joseph Weiland and to the children of my deceased daughter Magdalen Foos and to their heirs forever all the Rest and residue of all my property (or the proceeds thereof) of what nature both Real and Personal, and every interest in Property of which I shall die possessed or entitled to, to be divided and distributed into and in four equal parts of which the said Henry Joseph Weiland, the said William Joseph Weiland the the said Joseph Weiland are each to have one part and the children of the said Magdalena Foos deceased are to have the remaining part which remaining part is to be divided and distributed among the children of the said Magdalena Foos equally share and share alike. Fifth, Should any of the above named devisees or legatees die during my lifetime, leaving issue, then the share or amount herein to him or her devised or bequeathed shall go and belong to and be divided and distributed among such issue, as in cases of intestacy provided for by the laws of the State of New York. Sixth: I hereby authorize and empower my executors hereinafter named to sell and convey all the the Real Property of which I shall die seized, possessed of or entitled to charging them however to have due regard to the interests of the person and interesting there in under the terms hereof and to consult the wishes of each of them as shall have attained full age. Likewise I make constitute and appoint William Bauman of Irondequoit, NY and Peter Weber of Rochester, NY or the survivors of them to be Executors of this my last Will and Testament, hereby revoking all former Wills by me made. In Witness thereof I have hereunto subscribed my name and affixed my seal the 27th day of December in the year of our Lord one thousand eight hundred and eighty four. A Margetha Weiland LS The afore written instrument was subscribed by the said Anna Margaretha Weiland in our presence and acknowledged by her to each of us; and she at the same time declared the above instrument so subscribed to be her last Will and Testament and we, at her request, have signed our names as witnesses hereto in her presence and in the presence of each other and written opposite our names our respective places of residence. Wm F. Rampe, residing at Rochester NY B. H. Meyering, residing at Rochester NY Surrogate's Court In the matter of proving the last will and testament of Anna Margaretha Weiland Deceased. Monroe County SS William F Rampe and Bernard H Meyering being each fully sworn in open court, each for himself doth depose and say that he is a subscribing witness to the last Will and Testament of Anna Margaretha Weiland late of the City of Rochester in the County of Monroe and State of New York, deceased, did in the presence of each of these deponents subscribe her name at the end of the instrument in writing which is now here shown to these deponents, and which purports to be the last will and Testament of the said deceased, and which bears date on the 27th day of December one thousand eight hundred and eighty four. That the said deceased died on or about the 6th day of June 1886 at Rochester aforesaid, as deponents are informed and believe. That the said deceased did, at the time of subscribing her name to the said instrument as aforesaid declare the same to be her last Will and Testament and these deponents did thereupon subscribe their own respective names, at the end of said instrument as attesting witnesses to the execution thereof each at the request of the said deceased, and in her presence and the presence of each other. That the said deceased, at the time of so subscribing her name to said instrument as aforesaid and publishing said instrument as aforesaid was of full age and a citizen of the United Sates; that she appeared to be and deponents believed she was of sound mind, memory, and understanding and not under any restraint, and so deponents verily believe, in all respects competent to devise real estate; that each of these deponents saw the other sign his name to the said instrument in the presence of said deceased. A Adlington, Surrogate of Monroe County State of New York, County of Monroe, Surrogate's Office I hereby certify, that the annexed instrument being the Last Will and Testament of Anna Margaretha Weiland late of the City of Rochester in the County of Monroe and State of New York, deceased, has upon due proof, been this day admitted to probate by the Surrogate's Court of said County of Monroe as a will valid to pass real and personal property which said Last Will and Testament and the proofs and examinations take thereon, are recorded in the office of the Surrogate of said last mentioned county. In Testimony whereof, I have hereunto set my hand and affixed the seal of said Surrogates' Court at Rochester in said County this 22nd day of December in the year one thousand eight hundred and eighty six. Monroe County, 86 It appearing upon the proofs duly taken in respect to the Last Will and Testament of Anna Margaretha Weiland late of the City of Rochester in the County of Monroe and state of New York, deceased, that the said will was duly executed, and that the Anna Margaretha Weiland at the time she executed the same was for all respects, competent to devise real estate and not under restraint the said last Will and Testament and the proofs and examination are hereby recorded signed and executed by me pursuant to the provisions of the Code of Civil Procedure, this 22nd day of December A.
