Carr. This is to certify that after my death and the death of my wife my property shall be divided as herein Stated..Viz - Twenty five Dollars to John Howe. Twenty five Dollars to Charley Howe. Twenty five Dollars to Jonah Howe. Twenty five Dollars to Benjamin Howe and Thirty Dollars to Betsey Cady. One hundred Dollars to Wettley Parker. One hundred Dollars to Jane Ann Carr. One hundred Dollars to Louisa Miller. One hundred and fifty Dollars to Caroline Howe. And the Remainder to be divided Equally among my Six daughters. Viz- Betsey Cady, Wettley Parker, Sally Ford, Jane Ann Carr, Louisa Miller and Caroline Howe. - In witness whereof we have hereunto Set our hands and Seals the day and year first above written - (signed) Charles Howe In presence of Archibald F. Carr Benjamin Slocum Perinton State of New York County of Monroe Be it Remembered that at a Surrogates Court held at Rochester in and for the County of Monroe on the tenth day of September A.D. 1849 Before Moses Sperry Surrogate of Said County the Last Will and Testament of Charles Howe Late of the Town of Perinton in the County of Monroe aforesaid Deceased of which the preceeding Record of Will is a true copy was duly proved and admitted to probate as a will of Real & personal Estate after citation for that purpose had been issued, Served Returned and filed according to Law. And the following Depositions of the witnesses were thereupon taken and filed to Establish the Execution Genuineness and Validity of the Said will - County of Monroe Surrogates Court In the Matter of proving the will of Charles Howe - Deceased - County of Monroe. Benjamin Slocum of the Town of Perinton in the County of Monroe aforesaid being duly Sworn doth depose and Say that he is a Subscribing witness to the Last will and Testament of Charles Howe Late of the Town of Perinton in the County of Monroe aforesaid Deceased - And these deponents further Say that the Said Charles Howe the Said Testator did in the presence of these deponents Subscribe his name at the End of the instrument which is now Shown and Exhibited to this deponent and which purports to be the Last will and testament of the Said Charles Howe and which bears date on the Twenty fourth day of August in the Year of our Lord one thousand Eight hundred and forty six - And this deponent further says that the Said Testator did at the said time of Subscribing his name as aforesaid at the End of Said will declare the Said instrument So Subscribed and now Exhibited to be his last will and testament and this deponent and Archibald F. Carr did thereupon Subscribe their names at the End of the Said will as attesting witnesses thereto in the presence and at the Request of the Said Testator - And this deponent further says that at the Said time when the Said testator Subscribed his name to the Said last will as aforesaid and at the time of this deponents Subscribing his name as an attesting witness thereto as aforesaid the Said testator was of Sound mind and memory of full age to Execute a will and was not under and Restraint - And that the Said will now appears in all Respects as when So Executed without any alteration whatsoever - And this Deponent further says that the Signature of Archibald F. Carr as an attesting witness to the Said last will is the true and Genuine Signature of the Said Archibald F. Carr - That the Said Archibald F. Carr Signed his name as an attesting witness to Said will in the presence of this Deponent And this deponent further says that the Said Archibald F. Carr now Residing in Iona, Iona County, State of Michigan and without the jurisdiction of this court - Benjamin Slocum Subscribed & Sworn this 10th day of September A.D. 1849 Before me Moses Sperry Surrogate of Monroe County County of Monroe I Certify the preceeding to be a true Record of the will of Charles Howe Late of the Town of Perinton County of Monroe and State of New York aforesaid Deceased and of the proceedings proofs & Examinations had and taken thereon on admitting the said will to be proved and Recorded as a will of Real and personal Estate pursuant to the Statute in Such case made and provided and that all the same are Recorded and Examined the tenth day of September A.D. 1849 - (signed) Moses Sperry Surrogate of Monroe County
